Undersigned complainant / intervenor Judge Florentino V. Floro, Jr., most respectfully moves to reconsider the dismissal / denial Resolution dated 16 October, 2007 (for non-payment of docket / legal fees), WHICH HE PERSONALLY RECEIVED ON NOVEMBER 8, 2007, and further, he petitions to be allowed to pay the required docket and legal fees (duly reserved), to intervene in this case, to present evidence, to be heard, to consolidate the related disbarment case A.C. No. 7663, and under oath, he most respectfully depose and say, that:

GROUNDS:

1. Complainant was duly informed per television, internet breaking news and video reports, thusly:

S.C. PIO, Atty. Midas Marquez (September 26, 2007), stated:

“There are no hard and fast rules in the Supreme Court on how to handle such allegations, according to Marquez. There's no SOP really because cases like this aren't really very common, Marquez said. The court welcomes complaints, even anonymous complaints. We try to conduct investigations whenever we receive complaints, but we would really appreciate if these complaints would state in particular detail some of the allegations so that we could begin the investigation at some point. He lamented that such allegations could be bandied about in the media and tarnish the high court's reputation. "And then it would be picked up by the media. It's bringing the entire Supreme Court down.” (By Leila Salaverria, Tetch Torres, Inquirer, INQUIRER.net, 10:41 pm, 09/24/2007).

2. Complainant forthwith (about the last week of September and first week of October, 2007) called the Offices of the PIO, Clerk of Court, and OCAD, inter alia, to inquire regarding a) where to file or what offices would receive his contempt pleading, and b) how much legal / docket fees he should pay. Since he never got any correct information on the matter, he again called Atty. Winston Banel, but complainant again failed to get the answers to his questions on said procedure and fees. Complainant therefore called Atty. Midas Marquez, but complainant miserably failed to contact this officer.

3. While complainant was preparing his initiatory pleading in an internet café, he accidentally met a classmate of Atty. Midas Marquez. The following critical facts were duly NOTED by undersigned lest they be lost in his memory (storage), to wit:

The Ateneo alumni and Midas (from Pampanga, as she said) were classmates at Loyola Heights and they resided at the Eliazo and Cervini Halls; she studied Interdisciplinary Studies; ….

4. On October 5, 2007, complainant personally approached Atty. Winston Banel of the OCC, since he was the only one thereat who could answer the filing questions; then, complainant asked him where he should file and pay … but Banel said … he had no idea … ergo, complainant also went to the OCAD and an officer told him to go to the Documentation Division; complainant asked Mang Odi, the veteran employee thereat who handles all administrative cases or dockets; he stated that he had no idea about these matters, but he would accept the pleading, and Mang Bito would report the same to the Court; finally, complainant went to the ground floor filing office of all criminal and civil old and new cases; complainant personally went inside the room instead of just filing the 20 copies outside; but Sally and the other personnel thereat stated that they never and do not accept A.M.s since they only accept G.R.s, meaning, therefore, that complainant’s case is Administrative Matter and there is no docket fee required for that even if it is indirect contempt.

5. Complainant again went to Atty. Winston Bannel, OCC, and told him that the former wanted to talk to Atty. Felipa Anama or Atty. Ma. Luisa Villarama, but both were not available at that time. Along the corridors complainant accidentally met Atty. Midas Marquez who was talking to a woman. So, complainant approached Midas, and showed him more than 20 copies of the pleading plus the ORIGINAL. Complainant asked Midas, regarding where would file the pleading versus Senator Santiago and where to pay. Midas was in a great hurry and told complainant to file it anywhere, since he said, it is up to the Court to decide. Complainant then showed Atty. Marquez page 1 thereof, which the former read to the latter:

6. Complainant therefore asked Midas for help in filing the same, since the 3 offices of the OCC, OCAD and ground floor filing did not know about the procedure and the fees, since the instant case is an ADMINTRATIVE MATTER and there was no precedent in their 3 offices. But Midas insisted that it may be filed anywhere. Complainant told him that the OCC and the ground floor filing would not accept it, but the OCAD would, but would not accept any payment for fees. So, the last word of Atty. Midas was “go ahead file it and let the Court decide”. So, complainant had no option but to file it with the OCAD Documentation Division and Mang Odi and Mang Bito promised to report the same to the Court.

7. When the October 16, 2006 first Resolution was released, Atty. Winston Banel informed complainant that the particular resolution was still to be signed and the latter had to wait. So, on November 5, 2007, complainant personally went to the OCC, to get a copy thereof but Atty. Banel said that it was not yet released. So, complainant again called Atty. Banel on November 6 and the latter read through the phone the denial due to non-payment of docket fees. So, complainant again asked Banel regarding where to pay and how much docket and legal fees should be paid, considering that the only office which receives payment (ground floor receiving) refused to assess fees much less to receive the pleading and repeatedly informed complainant that there is no docket fee required for A.M. or administrative matter or administrative case.

8. With all these, it is not complainant’s fault that he failed to pay the docket fees. This is the first time in judicial history that an indirect contempt is being filed against a Senator and in an Administrative Matter. Complainant based his case and pleas upon the very statements and representations of Atty. Midas Marquez, who is the spokesman of the Court, PIO chief and p.s. of the Chief Justice.

9. Finally, complainant reproduces herein as integral part hereof all the allegations and contents of his filed October 5, 2007 pleading in this case to prove that if this and such initiatory pleading are given due course and granted, he could, beyond reasonable doubt show that respondent Miriam Santiago is guilty of indirect contempt of Court, gross misconduct and utter destruction of the Temples of Justice. Specifically, her lust for power (to become Chief Justice by 2010) goes beyond the legal, moral and the boundaries of fairness and justice. She, in no uncertain terms, wanted to destroy the persona of S.C. Associate Justice Antonio T. Carpio, and for this, she must not escape unpunished lest she further annihilate the entire judicial department by her EVIL touch.

“Court itself as an institution that has been falsely attacked, libel suits cannot be an adequate remedy. The Court concludes that respondent Gonzalez is guilty both of contempt of court in facie curiae and of gross misconduct as an officer of the court and member of the Bar.

ACCORDINGLY, the Court Resolved to SUSPEND Atty. Raul M. Gonzalez from the practice of law indefinitely and until further orders from this Court, the suspension to take effect immediately.”

MANILA, Philippines -- Senator Miriam Defensor-Santiago on Tuesday accused another Supreme Court justice of orchestrating the smear campaign against Justice Consuelo Ynares-Santiago. The feisty Senator said Justice Santiago was being implicated in a payoff scandal possibly to force her to inhibit herself from a multi-billion peso land case that is pending in the high court. The court met en banc Tuesday to investigate media reports that insinuated Justice Santiago received a gift-wrapped box containing P10 million and linked the incident to the hotly-contested Maysilo-Araneta University land case in Quezon City. Justice Santiago earlier penned a decision affirming a Court of Appeals ruling awarding ownership of the contested 34-hectare prime property to the heirs of a certain Homer Barque over other powerful claimants. The case was later reopened. Both sides are represented by big law firms.

In a press conference, Senator Santiago said she suspects that another Supreme Court justice could be behind the orchestrated media plot to bring Justice Santiago into disgrace, and compel her to inhibit herself from writing the decision. “I suggest that the Supreme Court investigate as well another Supreme Court justice who used to have connections in one of the law firms involved in this case. I do not say that the Justice devised the plot to destroy Justice Santiago but certainly he is involved in it. Hindi nila masuhulan kaya sisirain nila (They cannot bribe her, that’s why they try to destroy her instead). “That justice should be investigated. In the decision penned by Justice4 Santiago released last September 4, the high court ordered the Sandiganbayan to dismiss the case against Go because he could be charged for violation of Republic Act 3019 or the Anti-Graft Law Section 3 (g) because such provision only applies to public officers. Section 3 (g) of the Anti-Graft Law punishes "public officers who, on behalf of the government, enter into contracts or transactions manifestly and grossly disadvantageous to the government whether or not the public officer profited or will profit thereby." Go, and co-accused former transportation secretary Vicente Rivera Jr. were charged by the Office of the Ombudsman for allegedly conspiracy in connection with the mothballed NAIA terminal.

Two Cases: Piatco and QC Land Dispute

At the time of the alleged payoff, there were two controversial cases pending before the Supreme Court of which Ynares-Santiago penned the decisions. One is the Piatco case, wherein Ynares-Santiago, this month, ordered the dismissal of the graft case against the former chair and president of the Philippine International Air Terminals Co. Inc (Piatco), in connection with the voided contract to build the Ninoy Aquino International Airport Terminal 3—reversing an earlier Supreme Court decision (click here for our list of stories on NAIA-3). The High Court directed the Sandiganbayan to withdraw the criminal case versus Henry Go, saying that he was charged under the wrong provision of the Anti-Graft and Corrupt Practices Act. In that decision, Ynares-Santiago reversed a decision written by Justice Romeo Callejo in April, who retired soon after. Then, Callejo won, with a 3-2 vote. This time, Ynares-Santiago got two justices on her side, Adolf Azcuna and Cancio Garcia, who concurred with her. The deliberations in the third division over the Piatco case were described as “bitter.” It was in March that Ynares-Santiago fired Delis, at the height of the exchanges on the case. "No concrete proof has been shown," Moises Tolentino, Piatco spokesman, told Newsbreak, referring to the alleged bribery. "We are the victims here. Piatco has been battered by countless allusions of wrongdoings."

The other case, which is still pending before the Supreme Court en banc, reportedly has to do with a dispute over an estimated P1.7-billion, 34-hectare prime property in Quezon City, near the Ayala Heights subdivision. Ynares Santiago wrote a decision in December 2005 in favor of the new claimants, heirs of Homer Barque, invalidating the title of the long-time settlers, the Manotoks.

Court spokesman Jose Midas Marquez said the high court might also ask Sen. Miriam Defensor-Santiago to explain her statements to the media that another SC justice could be behind the smear campaign against Justice Santiago.
"As of now, we don’t know exactly what the good senator is referring to. If she is sure, maybe an affidavit will help. I suppose she will have to clarify that statement, the court will decide if there’s a need. We don’t know yet, we’re focusing on the columns of Mr. Macasaet," he said. Senator Santiago said Tuesday that the justice behind the smear campaign "used to belong to a law firm known to be interested" in the "lucrative Quezon city land dispute." She also said she would name the suspect justice when she gets more facts.

Demetria tried to intercede on behalf of suspected Chinese drug queen Yu Yuk Lai, alias Sze Yuk Lai, who went in and out of prison to play in a Manila casino. That same day, 21 July 2000, Chief Justice Davide, Jr., issued a Memorandum to Justice Demetria directing him to comment on the derogatory allegations in the news items.”

1. TIME IS OF THE ESSENCE. In view of the IRREPARABLE damage and injury to the legal profession and to the last bulwark of democracy, this Honorable Court of Last Resort, must defend itself and all the Justices, against EVIL. For, if these continuing attacks by respondent Miriam Defensor-Santiago (“Senator Santiago”, for brevity) are not stopped at the earliest opportunity, the judicial department would be helpless, all the Magistrates would be ridiculed, and like C. J. Panganiban, Senator Santiago would repeatedly SPIT upon, again and again upon the temple of justice.

“Sec. 6. Permissive joinder of parties.

All persons in whom or against whom any right to relief in respect to or arising out of the same transaction or series of transactions is alleged to exist, whether jointly, severally, or in the alternative, may, except as otherwise provided in these Rules, join as plaintiffs or be joined as defendants in one complaint, where any question of law or fact common to all such plaintiffs or to all such defendants may arise in the action; but the court may make such orders as may be just to prevent any plaintiff or defendant from being embarrassed or put to expense in connection with any proceedings in which he may have no interest.

Sec. 8. Necessary party.
A necessary party is one who is not indispensable but who ought to be joined as a party if complete relief is to be accorded as to those already parties, or for a complete determination or settlement of the claim subject of the action.

Sec. 11. Misjoinder and non-joinder of parties.

Neither misjoinder nor non-joinder of parties is ground for dismissal of an action. Parties may be dropped or added by order of the court on motion of any party or on its own initiative at any stage of the action and on such terms as are just. Any claim against a misjoined party may be severed and proceeded with separately.

Whenever the identity or name of a defendant is unknown, he may be sued as the unknown owner, heir, devisee, or by such other designation as the case may require; when his identity or true name is discovered, the pleading must be amended accordingly.”

– in that she miserably failed to be the embodiment of competence, integrity, and independence; (due to her ardent desire to be promoted, for power, lust for glory); she did not behave to promote public confidence in the integrity and impartiality of the judiciary; she conveyed to the public, an impression that she was so powerful / in a special position to influence others; she failed to follow the strict mandates of Rules 138, Rules of Court, and the Bill of Rights, RULE OF LAW, and due process;

R.A. 6713, Code of Ethical Standards for Government Officials --- the ethics and professionalism required of her by its circulars; Revised Administrative Code of 1987 as amended, on her oppression, bad faith/malice; The Civil Service Law, rules and regulations, including the constitutional mandate that “public office is a public trust, public officers shall serve with the highest degree of responsibility, integrity, efficiency, xxx.” (Businos vs. Ricafort, 283 SCRA 407).

These violations/acts and omissions of respondent definitely show her to be wanting in moral character and probity/good demeanor or unworthy to continue as officer of the Court, or unfit or unsafe person to enjoy the privileges of attorneys or for conducts which tend to bring reproach on the legal profession and to the High Tribunal, or to injure it in the favorable opinion of the public. She clearly demonstrated attitudes and courses of conduct wholly inconsistent with the approved professional standards, of having failed to live up to her duties as lawyer in consonance with the strictures of the lawyer’s oath, the cited Canons and Codes, thereby having occasioned unwarranted sufferings, humiliations and hardships on Magistrates. She was propelled by ill motives and malicious intentions, coupled with greed and lust for power or promotion, having failed in conscientiously seeing to it that justice permeates every aspect of her duties and profession, in conformity with the avowed duties of worthy members and officers of the Bar and the Bench.

Locus Standi

1. Complainant is a Filipino Citizen, a taxpayer, and a registered voter of 123 Dahlia, Alido, Malolos, Bulacan, his home and postal address, where he may be served with court processes, orders and judgments.

2. As a citizen, taxpayer and registered voter, undersigned has LOCUS STANDI or legal standing to file this case, is an interested / real party-in-interest and has direct, special and extra-ordinary interest in the subject matters of this landmark case.

The matter is a delicate one, quite obviously, and must thus be dealt with utmost circumspection, to avoid any FURTHER ridicule, attacks and humiliation not only of Magistrates but the Supreme Court itself. The issues posed by the petition / complaint transcend the persons of complainant, Justice Santiago and the specific Supreme Court Justice from the law firm that respondent accused HELPLESSLY in the media. These issues affect some of our most deeply held values in democracy --- the protection of civil and judicial rights, the tarnishing and perhaps total destruction of the judicial department/our temples of justice. The petition and complaint at bar concern all these values. It is the people on the line. It is we.

3. RIGHT TO INFORMATION: As a citizen, taxpayer and registered voter, complainant has a constitutional right to information on all matters of public concern, not the least of which is the ORCHESTRATED attack of respondent Santiago upon the 3 or 5 nominees would-be in the 2010 Chief Justice Race.

4. Until this petition/complaint is finally resolved, the entire legal profession, the judiciary and the litigants, inter alia, remain in the dark.

MANILA -- A senator apologized Thursday for saying China "invented corruption" during a heated hearing into an allegedly overpriced broadband deal Manila signed with a Chinese company.

"I will write a formal letter of apology to the Chinese ambassador," Senator Miriam Santiago, head of the Senate Foreign Relations Committee, told reporters. Santiago, famous for her mercurial temper, publicly berated China in a nationally televised hearing Wednesday into a US$330 million (euro235 million) broadband network contract that was awarded to China's Zhong Xing Telecommunication Equipment (ZTE) Corp. amid allegations of bribery and overpricing.

"China invented civilization in the East, but as well it invented corruption for all of human civilization," Santiago said Wednesday.

MANILA, Philippines -- Senator Miriam Defensor-Santiago has officially sent a letter of apology to the Chinese embassy, saying she suffers from chronic fatigue syndrome, which might explain her remarks alleging that the Chinese “invented corruption.” “These are not excuses, but perhaps they explain why I was not as diplomatic as I should have been,” Santiago said in her letter addressed to Chinese Ambassador to the Philippines Song Tao. The letter, dated September 27, started and ended with an apology.

“This is to respectfully apologize for whatever offense may have been caused by my remarks at the Senate hearing yesterday [September 26] on the proposed RP-China loan agreement…I humbly apologize to you, the People’s Republic of China, and the Chinese people. No offense was intended and I hope none will be taken,” she said.

MANILA, Philippines -- The Chinese embassy in Manila and the Federation of Filipino-Chinese Chamber of Commerce and Industry Inc. (FFCCCII) on Thursday protested Senator Miriam Defensor-Santiago’s anti-Chinese remarks during Wednesday’s Senate hearing on the controversial national broadband network (NBN) deal.

The protests came even as Santiago, earlier in the day, said she would apologize to the Chinese embassy for the comment she made Wednesday when, as the Senate continued its probe on the allegedly shady contract bagged by state-owned Chinese firm ZTE Corp. on Wednesday, she blurted out that the Chinese had “invented corruption.”

“Such kind of comments [are] neither fair nor correct,” the Chinese embassy protested. “We believe that the Philippine government and the people of the Philippines will not agree to that. It is known to all that anti-corruption is a common task faced by all the countries of the world. Corruption exists not only in China, nor was it created by China,” the embassy said. “The Chinese government has all along devoted itself to the building of an honest and clean government and combat against all forms of corruption,” it added. “In recent years, the Chinese government has adopted even tougher measures in combat against corruption and achieved prominent results. [We] think people of insight can all see it.”

On the other hand, the FFCCCII demanded an apology in behalf of ethnic Chinese, not just in the country but also around the world. “While her [Santiago’s] outburst may have been made in the heat of emotion during the ZTE-NBN probe, the general and sweeping racial slur is directed against all Chinese and ethnic Chinese around the world,” the FFCCCII said in a statement. “In the interest of fair play, we at the Federation of Filipino-Chinese Chambers of Commerce and Industry -- in behalf of all fellow Chinese-Filipinos -- demand an immediate and unqualified apology from Senator Santiago,” it added. The FFCCCII said it was “taken aback by the irresponsible and insensitive statements” of Santiago against the Chinese.

It said the alleged irregularities in the “isolated” NBN-ZTE transaction “cannot be the basis of the unwarranted and regrettable condemnation” by the senator. “This unfortunate utterance is all the more deplorable since Senator Santiago is not only a senator of the republic, but more so, is chairman of the Senate foreign relations committee,” the group said. The federation has more than 50,000 members in 170 chapters around the country.

Voted out of the shortlist of nominees for the post of chief justice, Sen. Miriam Defensor Santiago vowed get back at the Supreme Court and the Judicial Bar Council (JBC) by slashing their budgets. “I am foaming in the mouth, I am hitting the roof.”

Panganiban blamed

JBC sources told The Manila Times that Senior Associate Justice Reynato Puno and Associate Justice Leonardo Quisumbing as topnotchers with seven votes each. Associate Justice Consuelo Ynares-Santiago and Angelina Sandoval-Gutierrez got five votes each.

The JBC also shut out Associate Justice Antonio Carpio, who penned the scathing Court decision that junked the people’s initiative bid of administration allies.

A furious Santiago accused Panganiban of orchestrating her defeat. She said Panganiban punished her for being a close ally of President Arroyo.

But she did not offer any proof except to cite the chief justice’s closeness to former senator Jovito Salonga, a critic of the administration.

Santiago then promised to push for a reduction of the Supreme Court’s budget to 2005 levels and that of the JBC to just P100. JBC member Sen. Francis Pangilinan said the non-inclusion of Santiago sent a message. “I think the judiciary is not yet open in accepting an outsider,” Pangilinan said. Gonzalez, another JBC member, tried to appease the senator, saying some members fought for her nomination. The process of arriving at a shortlist was marred by controversy over the public interviews after the Supreme Court justices snubbed the JBC’s call for public interviews.

SENATOR Miriam Defensor Santiago yesterday accused Chief Justice Artemio Panganiban of plotting with other Supreme Court justices to keep her off the list of nominees for his position when he retires Dec. 7.

“I’m foaming at the mouth. I’m hitting the roof. I’m homicidal. I’m suicidal. I’m ballistic. I spit in the face of Chief Justice Artemio Panganiban,” she said in a privilege speech after learning that the Judicial and Bar Council left her off the short list of nominees. “I am not interested in becoming chief justice if I am going to be surrounded by idiots,” she said. Santiago tore into Panganiban, who sits as chairman of the council, accusing him of spearheading the campaign to blacklist her for being a court outsider.
“There was a plot to disqualify me from the soon-to-be-vacated post of chief justice on the suspicion that since I am perceived to be an intimate political ally of the President, once nominated, I would be appointed... Mr. Panganiban was the mastermind of this thinly veiled plot to disqualify me. He and his cohorts want to uphold [the tradition] that no outsider should be appointed chief justice.”

Santiago also attacked the members of the bar council as “earthworms” for going along with Panganiban in protecting a tradition that was nowhere to be found in the Constitution.

“I prefer the company of my colleagues in the Philippine Senate anytime, anywhere, any day, to the company of those idiots in the Supreme Court,” she said. “They are idiots not only in the intellectual but also in the moral sense [because they are] so devoid of any sense of moral propriety that they are perfectly capable of voting for self-interest over the rights protected by the Constitution in favor of other people.”

Santiago described her disqualification as “hypocrisy, naked,” and promised to examine the Supreme Court’s funds more closely and to recommend a reduction in its budget.

“If you want a boxing match, I’ll oblige. If you want a debate at Plaza Miranda, that’s fine with me too,” she said.

Senate Majority Leader Francis Pangilinan said Carpio was left out because he didn’t get enough votes while Santiago was dropped because she was an outsider.

Miriam hits back, seeks JBC abolition

At the risk of being accused of sour-graping, Senator Miriam Defensor Santiago yesterday called for the abolition of the Judicial and Bar Council by amending the Constitution, and slashing its budget next year “to the minimum.”

Santiago made the proposal after the JBC refused to extend the period of nomination for the chief justice, but gave the candidates for ombudsman a wider leeway. Santiago, a former regional trial court judge, said that technically, the JBC cannot be abolished because it is created by the Constitution, but Congress can give a warning by slashing its budget.

“Yes, I myself have a personal interest, because I was nominated for chief justice. My nomination was excluded because the JBC refused to extend the period of nomination,” Santiago said. “But I am acting in good faith, and not out of personal vengeance.

“Prior to all these controversies, I already told Senator Francis Pangilinan, a JBC member, that I will not be interested in the post of chief justice until my term expires in 2010.”

Santiago also raised suspicions that the JBC could have unwittingly excluded qualified candidates by calling for nominations on Nov. 4, and imposing a deadline of Nov. 10, thus, depriving the public to be informed and to prepare nominations. “Under the present system, it is possible for a Supreme Court justice to support his personal protegés for appointment to the JBC, and in turn for those protegés to vote for him as chief justice when a vacancy occurs. That would be very unhealthy for the judicial system.”

Assassination Attempt

Miriam was suddenly victimized in a car crash that remains unsolved up to the present. On the highway during a speaking tour, Miriam suffered life-threatening injuries, after a car rammed her vehicle on the side where she was seated. Bloodied and unconscious, she was airlifted by helicopter from Tarlac to Metro Manila and taken to the Metropolitan Hospital.

Her staff decided not to reveal the true extent of Miriam's injuries, so as not to prejudice her presidential chances. But she was completely immobile and could not walk nor even move her arms. Her facial injuries made it impossible for her to talk, and she had to communicate by writing. She underwent surgery, during which she had a near-death experience.

Personal Tragedy – Mental and Physical Health Deterioration

Miriam's husband Narciso Y. Santiago Jr. from Tarlac, nicknamed "Jun," serves as presidential adviser on revenue enhancement. Under President Estrada, Jun served as undersecretary of local government. The couple has two birth children, Narciso III and Alexander Robert.

Miriam lost her younger son in November 2003. He was only 22 years old and was on the Dean's List at the Ateneo University. In the years that followed her personal tragedy, Miriam's irreparable grief manifested itself as a health failure, including a minor stroke (thankfully without lingering effects), hypertension, pinched nerves, high cholesterol, and most recently, unexplained anorexia (an eating disorder) which caused her to lose weight.

“Perhaps we can add details on the son's suicide death. Miriam said something about UP Law Professors and classmates teasing her son about her being crazy or unhinged. This supposedly drove her son to suicide. She tried to sue UP but you can ask any UP law student and it's standard practice to tuant, tease, initmidate etc. any law student. Answer: The above statement an understatement because "tease and intimidate" should be replaced by "insulted". It is not common to "insult people and definitely not common to insult even members of your family" in an interview. You can start by making a thorough investigation a) checking police records/interviews from witnesses b) ask the family themselves including Miriam c) conduct interviews from former classmates and professors. Do not rely on Miriam statements alone as she might be angry at the time her son committed suicide i.e. her allegations might be unfounded. She earned a Bachelor of Laws, from the University of the Philippines Diliman in 1969. Her classmates include former Senate President Franklin Drilon, San Juan Representative Ronaldo Zamora, and Eli Pamatong. Miriam took the 1969 Bar Exams and received a 78% average grade, to her great dismay.[3] [4] Her classmates Zamora and Drilon were first and third respectively, getting high grades, eventually landing in top law firms. In stark contrast, Santiago ended up teaching Political Science to undergraduates at Trinity College of Quezon City.[3]

To bolster her credentials and do over her dismal performance in the bar exam, Santiago resorted to higher learning. She attended the University of Michigan Law School from 1974 to 1976, earning degrees in Master of Laws and Doctor of Juridical Science.[3]

Santiago again ran for president in the 1998 elections and invited fellow Senator Francisco Tatad to be her running mate. Pwersa ng Masang Pilipino candidate Joseph Estrada won the election and became president, though Santiago again made claims of election fraud. After the election, Santiago returned to the senate.

When she lost in the Senate race of 2001, she worked on updating her law and political science textbooks, which were last released 2002.[6]Official Publications List, Central Book Store, 2002.

However, a considerable number of lawyers, academicians, political analysts, journalists, and activists measure her as a traditional corrupt politician, carrying high levels of arrogance, greed for power, and opportunism. She is often quoted as having described less educated Filipinos as "species of lower life forms"

On January 13, 2001, Santiago and ten other senators voted against the opening of a bank envelope. The vote ended the impeachment trial and led to the Second People Power Revolution which removed Estrada from office.

Senator Santiago announced publicly that "I will jump headfirst from a helicopter in Luneta if Estrada gets removed from power" but later recanted and said "I lied".[11]

Santiago ran for reelection in the 2001 elections following the Estrada's removal, but was not re-elected. It was at this point in her career that tragedy struck her personal life. Her favorite son, AR, an aspiring law student, failed an exam and took his life. His last missive bewailed the peer pressure he suffered as the son of a notoriously corrupt politician.[12] In retaliation, Miriam vowed to retire permanently from politics and devote her time to the persecution of the law school professors whom she held responsible for her son's suicide.[13]

In the 2004 elections, Santiago reneged on her vow and ran again for senator, this time switching to the President Gloria Macapagal Arroyo's K4 coalition and won. She currently holds the position of chairperson and lone member of the People's Reform Party. Her office in West Triangle, Quezon City offers a library of her written books.

Santiago announced her intentions to apply as one of the possible candidates to fill the post of Supreme Court Chief Justice Artemio Panganiban upon his retirement in December 2006. Ultimately, the Judicial and Bar Council removed Santiago from the shortlist of candidates for the position.[14] Santiago openly criticized the move, questioning the qualifications of Panganiban and labelling the Supreme Court an "old boy's club" for not admitting outsiders into their fold.[15] The shortlisting came after all the nominees, save for Santiago, boycotted a public interview held by the Judicial Bar Council that aimed to improve the institution's transparency.[16]

On July 10, 2007, Santiago said that an acquittal of ousted President Estrada will consequently cast doubts on the legitimacy of President Arroyo’s assumption into office. She advised that only a conviction will be to the best interest of Mrs. Arroyo: “If President Estrada is acquitted now, we will have a dilemma: What then is the status of President Arroyo? Two, if he is acquitted, the conclusion can only be that there was no plunder and therefore there was no basis to remove him from office. What then is the basis of President Arroyo in the elections (in 2004) that followed after she was installed (in 2001)? That in itself will create another legal dilemma,”.[17] Further, Santiago accused some winning senators of having ‘paid their way to office’ (P200 million is the non-negotiable minimum amount to carry out a senatorial electoral campaign “which is simply unethical”).

Health - Chronic fatigue syndrome and anorexia

On September 28, 2007, Miriam Defensor-Santiago stated that she is sick of chronic fatigue syndrome. [25] (CFS) is highly debilitating disorder marked by chronic mental and physical exhaustion, often severe, and by other specific symptoms, arising in previously healthy and active persons. [26] She also suffered from Anorexia (symptom), the decreased sensation of appetite (disorders that cause (harmful) anorexia include anorexia nervosa, severe depression, cancer, dementia, AIDS, and chronic renal failure and the use of certain drugs, particularly stimulants and narcotics. Environmentally induced disorders such as altitude sickness can also trigger an acute form of anorexia. Anorexia may also be seen in congestive heart failure, perhaps due to congestion of the liver with venous blood).
Jurisprudence

I begin by referring to the authority of the Supreme Court to discipline officers of the court and members of the Bar. The Supreme Court, as regulator and guardian of the legal profession, has plenary disciplinary authority over attorneys. The authority to discipline lawyers stems from the Court's constitutional mandate to regulate admission to the practice of law, which includes as well authority to regulate the practice itself of law. Quite apart from this constitutional mandate, the disciplinary authority of the Supreme Court over members of the Bar is an inherent power incidental to the proper administration of justice and essential to an orderly discharge of judicial functions. Moreover, the Supreme Court has inherent power to punish for contempt, to control in the furtherance of justice the conduct of ministerial officers of the Court including lawyers and all other persons connected in any manner with a case before the Court. The power to punish for contempt is "necessary for its own protection against an improper interference with the due administration of justice," "(it) is not dependent upon the complaint of any of the parties litigant.

It has been held that contempt of court is a defiance of the authority, justice or dignity of the court, such conduct as tends to bring the authority and administration of the law into disrespect. It signifies not only a willful disregard or disobedience of the court’s order but such conduct as tends to bring the authority of the court and the administration of law into disrepute or in some manner to impede the due administration of justice. (Abad v. Somera, G.R. No. 82216, July 2, 1990, 187 SCRA 75, 84-85.)

“On 9 February 1988, petitioner Zaldivar filed with the Court a Motion to Cite in Contempt 11 directed at respondent Gonzalez. The Motion cited as bases the acts of respondent Gonzalez in: (1) having caused the filing of the information against petitioner in Criminal Case No. 12570 before the Sandiganbayan; and (2) issuing certain allegedly contemptuous statements to the media in relation to the proceedings in G.R. No. 80578. In respect of the latter, petitioner annexed to his Motion a photocopy of a news article, reproduced here in toto, which appeared in the 30 November 1987 issue of the "Philippine Daily Globe:"

Tanod Scores SC for Quashing Graft Case

TANODBAYAN Justice Raul M. Gonzalez said yesterday the Supreme Court order stopping him from investigating graft cases involving Antique Gov. Enrique Zaldivar can aggravate the thought that affluent persons "can prevent the progress of a trial."

What I am afraid of (with the issuance of the order) is that it appears that while rich and influential persons get favorable actions from the Supreme Court, it is difficult for an ordinary litigant to get his petition to be given due course. Gonzalez told the Daily Globe in an exclusive interview.

Gonzalez said the high tribunal's order "heightens the people's apprehension over the justice system in this country, especially because the people have been thinking that only the small fly can get it while big fishes go scot-free."

Gonzalez was reacting to an order issued by the tribunal last week after Zaldivar petitioned the court to stop the Tanodbayan from investigating graft cases filed against him. Zaldivar had charged that Gonzalez was biased in his investigations because the latter wanted to help promote the political fortunes of a friend from Antique, lawyer Bonifacio Alentajan. Acting on Zaldivar's petition, the high court stopped Gonzalez from investigating a graft charge against the governor, and from instituting any complaint with the Sandiganbayan. While President Aquino had been prodding me to prosecute graft cases even if they involve the high and mighty, the Supreme Court had been restraining me. Gonzalez said.

In accordance with the President's order, Gonzalez said he had filed graft cases against two "very powerful" officials of the Aquino government-Commissioner Quintin Doromal of the Presidential Commission on Good Government and Secretary Jiamil I.M. Dianlan of the Office of Muslim Affairs and Cultural Communities. While I don't wish to discuss the merits of the Zaldivar petition before the Supreme Court, I am a little bit disturbed that (the order) can aggravate the thinking of some people that affluent persons can prevent the progress of a trial, he said.

He disclosed that he had a talk with the Chief Executive over the weekend and that while she symphatizes with local officials who are charged in court during election time, 'She said that it might be a disservice to the people and the voters who are entitled to know their candidates.

Gonzalez said that while some cases filed against local officials during election time could be mere harassment suits, the Constitution makes it a right of every citizen to be informed of the character of tile candidate, who should be subject to scrutiny. (Emphasis supplied)
The power to punish for contempt of court does not exhaust the scope of disciplinary authority of the Court over lawyers. The disciplinary authority of the Court over members of the Bar is but corollary to the Court's exclusive power of admission to the Bar. A lawyer is not merely a professional but also an officer of the court and as such, he is called upon to share in the task and responsibility of dispensing justice and resolving disputes in society. Any act on his part which visibly tends to obstruct, pervert, or impede and degrade the administration of justice constitutes both professional misconduct calling for the exercise of disciplinary action against him, and contumacious conduct warranting application of the contempt power.

It is sometimes asserted that in the exercise of the power to punish for contempt or of the disciplinary authority of the Court over members of the Bar, the Court is acting as offended party, prosecutor and arbiter at one and the same time. Thus, in the present case, respondent Gonzalez first sought to get some members of the Court to inhibit themselves in the resolution of this case for alleged bias and prejudice against him. A little later, he in effect asked the whole Court to inhibit itself from passing upon the issues involved in this proceeding and to pass on responsibility for this matter to the Integrated Bar of the Philippines, upon the ground that respondent cannot expect due process from this Court, that the Court has become incapable of judging him impartially and fairly. Respondent Gonzalez misconceives the nature of the proceeding at bar as well as the function of the members of the Court in such proceeding.

In Salcedo v. Hernandez, Atty. Vicente Francisco filed a Motion before the Supreme Court which contained the following paragraph (in translation):

We should like frankly and respectfully to make it of record that the resolution of this court, denying our motion for reconsideration, is absolutely erroneous and constitutes an outrage to the rights of the petitioner Felipe Salcedo and a mockery of the popular will expressed at the polls in the municipality of Tiaong, Tayabas. We wish to exhaust all the means within our power in order that this error may be corrected by the very court which has committed it, because we should not want that some citizen, particularly some voter of the municipality of Tiaong, Tayabas, resort to the press publicly to denounce, as he has a right to do, the judicial outrage of which the herein petitioner has been the victim, and because it is our utmost desire to safeguard the prestige of this honorable court and of each and every member thereof in the eyes of the public. But, at the same time we wish to state sincerely that erroneous decisions like these, which the affected party and his thousands of voters will necessarily consider unjust, increase the proselytes of sakdalism and make the public lose confidence in the administration of justice. (61 Phil. at 726; emphasis supplied)

When required by the Court to show cause why he should not be declared in contempt, Atty. Francisco responded by saying that it was not contempt to tell the truth. Examining the statements made above, the Court held:

... [they] disclose, in the opinion of this court, an inexcusable disrespect of the authority of the court and an intentional contempt of its dignity, because the court is thereby charged with no less than having proceeded in utter disregard of the laws, the rights of the parties, and of the untoward consequences, or with having abused its power and mocked and flouted the rights of Attorney Vicente J. Francisco's client, because the acts of outraging and mocking from which the words 'outrage' and mockery' used therein are derived, means exactly the same as all these, according to the Dictionary of the Spanish Language published by the Spanish Academy (Dictionary of the Spanish Language, 15th ed., pages 132-513).

The insertion of the phrases in question in said motion of Attorney Vicente J. Francisco, for many years a member of the Philippine bar, was neither justified nor in the least necessary, because in order to call the attention of the court in a special way to the essential points relied upon in his argument and to emphasize the force thereof, the many reasons stated in his said motion were sufficient and the phrases in question were superfluous. In order to appeal to reason and justice, it is highly improper and amiss to make trouble and resort to threats, as Attorney Vicente J. Francisco has done, because both means are annoying and good practice can ever sanction them by reason of their natural tendency to disturb and hinder the free exercise of a serene and impartial judgment, particularly in judicial matters, in the consideration of questions submitted for resolution.

There is no question that said paragraph of Attorney Vicente J. Francisco's motion contains a more or less veiled threat to the court because it is insinuated therein, after the author shows the course which the voters of Tiaong should follow in case he fails in his attempt, that they will resort to the press for the purpose of denouncing, what he claims to be a judicial outrage of which his client has been the victim; and because he states in a threatening manner with the intention of predisposing the mind of the reader against the court, thus creating an atmosphere of prejudices against it in order to make it odious in the public eye, that decisions of the nature of that referred to in his motion to promote distrust in the administration of justice and increase the proselytes of sakdalism a movement with seditious and revolutionary tendencies the activities of which, as is of public knowledge, occurred in this country a few days ago. This cannot mean otherwise than contempt of the dignity of the court and disrespect of the authority thereof on the part of Attorney Vicente J. Francisco, because he presumes that the court is so devoid of the sense of justice that, if he did not resort to intimidation, it would maintain its error notwithstanding the fact that it may be proven, with good reasons, that it has acted erroneously.

As a member of the bar and an officer of this court, Attorney Vicente J. Francisco, as any attorney, is in duty bound to uphold its dignity and authority and to defend its integrity, not only because it had conferred upon him the high privilege, not a right (Malcolm, Legal Ethics, 158 and 160), of being what he now is: a priest of justice (In re Thatcher, 80 Ohio St., Rep., 492, 669), but also because in so doing, he neither creates nor promotes distrust in the administration of justice, and prevents anybody from harboring and encouraging discontent which, in many cases, is the source of disorder, thus undermining the foundation upon which rests that bulwark called judicial power to which those who are aggrieved turn for protection and relief (61 Phil. at 727-728; emphasis supplied)

It should not be supposed that the six (6) cases above discussed exhaust our case law on this matter. In the following cases, among others, the Supreme Court punished for contempt or administratively disciplined lawyers who had made statements not very different from those made in the cases discussed above:

1) In re Wenceslao Laureta, 148 SCRA 382 (1987);

2) Borromeo v. Court of appeals, 87 SCRA 67 (1978);

3) Rheem of the Philippines v. Ferrer, 20 SCRA 441 (1967);

4) Malolos v. Reyes, 1 SCRA 559 (1961);

5) De Joya, et al. v. Court of First Instance of Rizal, Pasay City Branch, 99 Phil. 907 (1956);

6) People v. Venturanza, et al., 98 Phil. 211 (1956);

7) In re Suzano A. Velasquez, per curiam Resolution (unreported), Promulgated 29 April 1955;

8) Cornejo v. Tan, 85 Phil. 772 (1950);

9) People v. Carillon, 77 Phil. 572 (1946);

10) Intestate Estate of Rosario 0lba; Contempt Proceedings against Antonio Franco, 67 Phil. 312 (1939); and

11) Lualhati v. Albert, 57 Phil. 86 (1932).

But it is the cardinal condition of all such criticism that it shall be bonafide and shall not spill over the walls of decency and propriety. A wide chasm exists between fair criticism, on the one hand, and abuse and slander of courts and the judges thereof, on the other. Intemperate and unfair criticism is a gross violation of the duty of respect to courts. It is such a misconduct that subjects a lawyer to disciplinary action.

The lawyer's duty to render respectful subordination to the courts is essential to the orderly administration of justice. Hence, in the assertion of their clients' rights, lawyers even those gifted with superior intellect are enjoined to rein up their tempers.
Only slightly (if at all) less important is the public interest in the capacity of the Court effectively to prevent and control professional misconduct on the part of lawyers who are, first and foremost, indispensable participants in the task of rendering justice to every man. Some courts have held, persuasively it appears to us, that a lawyer's right of free expression may have to be more limited than that of a layman.

It is well to recall that respondent Gonzalez, apart from being a lawyer and an officer of the court, is also a Special Prosecutor who owes duties of fidelity and respect to the Republic and to this Court as the embodiment and the repository of the judicial power in the government of the Republic. The responsibility of the respondent "to uphold the dignity and authority of this Court' and "not to promote distrust in the administration of justice is heavier than that of a private practicing lawyer.

Respondent Gonzalez claims to be and he is, of course, entitled to criticize the rulings of this Court, to point out where he feels the Court may have lapsed into error. Once more, however, the right of criticism is not unlimited. Its limits were marked out by Mr. Justice Castro in In re Almacen which are worth noting.

Court itself as an institution that has been falsely attacked, libel suits cannot be an adequate remedy. The Court concludes that respondent Gonzalez is guilty both of contempt of court in facie curiae and of gross misconduct as an officer of the court and member of the Bar.

ACCORDINGLY, the Court Resolved to SUSPEND Atty. Raul M. Gonzalez from the practice of law indefinitely and until further orders from this Court, the suspension to take effect immediately.

MANILA, Philippines -- As a trial-court judge, Florentino V. Floro Jr. acknowledged that he regularly sought the counsel of three elves only he could see. The Supreme Court deemed him unfit to serve and fired him last year.

Case closed? Not in the Philippines, where vampires are said to prey on unwary travelers and wealthy politicians consult fortune tellers and card readers. Mr. Floro, 54 years old, has become a media celebrity. He is now wielding his new clout to campaign for the return of his job -- and exact vengeance on the Supreme Court.

Helping him, he says, are his three invisible companions. "Angel" is the neutral force, he says. "Armand" is a benign influence. "Luis," whom Mr. Floro describes as the "king of kings," is an avenger.

Mr. Floro has become a regular on Philippine television. Often he is asked to make predictions with the help of his invisible friends. "They say your show will be taken off the air if you don't feature me more often," was Mr. Floro's reply to one interviewer.

The day after Mr. Floro's first appearance on television last year, hundreds of people turned up at his house in a dusty Manila suburb hoping he could use his supernatural powers to heal their illnesses. Now Mr. Floro, who travels by bus, is regularly recognized on the street.

The Supreme Court says its medical clinic determined that Mr. Floro was suffering from psychosis. Even so, a series of disturbing incidents appear to have the nation's top jurists rattled. According to local newspaper reports, a mysterious fire in January destroyed the Supreme Court's crest in its session hall, and a number of members of the court and their close family members have developed serious illnesses or have fallen victim to car accidents.

Enough bizarre things have happened that in July, the Supreme Court issued an en banc resolution asking Mr. Floro to desist in his threats of "ungodly reprisal." The Supreme Court's spokesman declined to elaborate.

Mr. Floro says he is not suffering from psychosis, and that he's not to blame for the incidents. He points the finger squarely at "king of kings" elf Luis, who Mr. Floro says is bent on cleaning up what he says is the Philippines' corrupt legal system.

Mr. Floro says he never consulted the invisible elves over judicial decisions and the fact that he puts faith in them should make no difference to his career. "It shouldn't matter what I believe in, whether it's Jesus, Muhammad, or Luis, Armand and Angel," he says in an interview.

The Philippines has a long history of mixing organized religion with a deep belief in the supernatural. During the 1950s and 1960s, when the Southeast Asian nation was already an independent republic, the Central Intelligence Agency stoked fears of vampires and ghouls to help its preferred candidates win elections.

The elf, or "duwende," is one of a rich pantheon of supernatural beings that predate the Philippines' colonization by Spanish conquistadors in the 16th century. Many Filipinos make pilgrimages to Mount Banahaw, just south of Manila, which is reputedly the country's capital for elves and other beings.

He argued Mr. Floro is mentally fit and argues the former judge's beliefs aren't so unusual in the Philippine context.

Like many others in the Philippines, Mr. Floro says he himself is a Roman Catholic, and once studied to be a priest. He recalls that he wasn't convinced that serving the church was necessarily the best way to serve other Filipinos. He says he thought he could improve more people's lives if he became a lawyer, and he handily passed the bar exams.

Mr. Floro says he first realized he had the power to perceive Armand, Angel and Luis in 1986. In 1998, he applied to switch from being a lawyer to becoming a judge. He passed a mandatory psychiatric evaluation applied to all prospective judges and was sworn in as a regional trial-court judge in November of that year, handling both civil and criminal cases in Malabon, a district in greater Manila.

In 1999, Mr. Floro invited officials from the Supreme Court's administration unit to inspect his small courtroom. What they found unnerved them, and the Supreme Court convened a hearing to determine whether Mr. Floro should be removed from the bench.

According to Supreme Court papers, the court investigators presenting evidence at the hearing said they found Mr. Floro wearing blue robes instead of the normal black. Mr. Floro's own witnesses testified that he wore black on Fridays to "recharge his psychic powers."

The court investigators also reported that Mr. Floro began court proceedings with readings from the Book of Revelation and conducted hands-on psychic healing sessions for members of the public in his chambers during recesses. The investigators said Mr. Floro would sometimes enter a trance to write his rulings.

During the hearing, Mr. Floro revealed his contact with his elves. He also shared with the judges that Luis predicted that then-Philippine President Joseph Estrada would be ousted from office; Mr. Estrada was forced from power by a popular revolt two years later in 2001 and was sentenced last week to life in prison for corruption.

In March 2006, after lengthy delays, the Supreme Court finally dismissed Mr. Floro from the court service, largely because of his belief in the supernatural. Even though Mr. Floro says the elves played no part in his judicial decisions, the Supreme Court justices said his broad faith in mysticism and supernatural phenomena had affected his work. "Lest we be misconstrued, we do not denigrate such a belief system," Associate Justice Minita Chico-Nazario wrote in the Supreme Court's verdict. "However, such beliefs, especially since Judge Floro acted on them, are at odds with the critical and impartial thinking required of a judge under our judicial system."

Mr. Floro dissents. He has filed three appeals of the Supreme Court's decision since then and is continuing his campaign on local television and on the Internet. The Supreme Court hasn't reversed any of his decisions after suspending and later removing him from the bench.

When elves take the law into their own hands...

Florentino V. Floro Jr. is was a trial judge in Manila, Philippines. Things were going fine for Florentino until he saw fit to inform the public that he has three tiny little friends - elves that only he can see and hear.
After being fired, Floro latched on to the gullibility of an already superstitious public, became a media celebrity and has now vowed to exact revenge on the Supreme Court, using the talents of his invisible buds:

"It shouldn't matter what I believe in, whether it's Jesus, Muhammad, or Luis, Armand and Angel"

Angel, Armand and Luis are the elves' names, in case you're interested. Floro calls Luis "the king of kings". Plenty of people are lining up and defending Floro, saying that his beliefs should be just as valid as those who pray to Jesus for help. I agree with that, but I think that I would go a bit further and say that if a judge talks to someone who isn't there, whether he has pointy ears or wears sandals, perhaps he's really more suited to be a weird, vengeful media personality than to help decide the fate of the accused.

The court kicked Florentino Floro Jr. off the bench largely because of his belief in the supernatural, the Wall Street Journal reports (sub. req.). A medical clinic determined that the judge was suffering from psychosis.
Since then Floro has battled to get his job back, appearing on TV and winning converts who seek his healing powers. At the same time, a series of unfortunate incidents have befallen the supreme court justices or their families, including serious illnesses and car accidents.
Floro says the person to blame for the mishaps is one of the elves, "Luis," a "king of kings" who is an avenger. He told the newspaper that the elves help him predict the future, but he has never consulted them when issuing judicial decisions.
The Supreme Court has not reversed any of Floro’s decisions since firing him.

Ugh. This news is disgusting. I'm originally Chinese from the Philippines. Knowing my relatives, I feel that the widespread religious (mainly Catholic) and superstitious views there are what help keep the Philippines backward, ignorant, poor, and corrupt. People from there (including my family) believe in all sorts of ridiculous crap. They are ignorant and cynical about science, but they pony up to faith healers and fortune tellers. The lack of critical thought hurts them big time.

Apr 22 - Looking back fondly on the Psychic Judge

In the comments of the last post the issue of whether or not I should write a book on the Tarot arose. I mentioned that I’d like to, but wasn’t sure whether I could add anything fresh to the subject.
At which point, for whatever reason, R the P googled my name. He said in the comments that someone had mentioned me as ‘prestigious’. Ahem, yes. So they have.
That was Judge Florentino Floro, the psychic judge, whose case drew quite a bit of interest a year or so ago. I even wrote an article about him in Noumenal.net.
The Judge was kind enough to respond to my article in comments, and also sent me a few emails. Later he sent me a copy of his 3rd addendum to his Supreme Court appeal, which mentioned me and the ‘prestigious’ Noumenal.net. Calling Noumenal.net ‘prestigious’ is kind of like calling RPBE pie ‘gourmet’. I mean, its good, but it ain’t gourmet.
I followed some of the links that R the P googled, and found one that belonged to a lawyer who was also mentioned in the Judge’s appeal. Said lawyer mentions me on his blog, Lowering the Bar, takes my words all out of context and makes me sound a bit daffy. I think I was the punchline of his joke, actually. But what can we expect from a lawyer?

Or at least that’s what I thought. In a third supplemental pleading that Judge Floro forwarded me last night, I was a little surprised, but proud, to see that he had cited me as one of a number of worldwide authorities on his case. The pleading starts by reprinting most of an article on the case by Justice William Bedsworth, an associate justice in California’s 4th District Court of Appeals, who has his own blog and who frequently publishes articles in the legal papers here as well. Judge Floro also cites (among others) another California attorney, Lester Hardy; David Pannick, a British attorney; Ken Blanchard, a management and business writer (The One Minute Manager); a French blogger; and Che, a tarot reader and clairvoyant who shares her home with "a couple of spirits, some shadow people, some black blobs, one homunculus and a cat."
The actual appeal quotes my article pretty much verbatim, but unless you understand the context of the black blobs and homunculi, then you’re probably going to think I’m a nut.
Well I am kind of a nut but not because I see dead people. Well… I don’t see them much. Once in a while maybe. I hear them more often than see them. Anyway, tangent. I don’t really feel the need to defend myself to some hyper-materialist lawyer dude. I see what I see, I do what I do, and I probably enjoy life more than him. Well, maybe not these days…
Anyway, I know the judge lost his appeal, and I’d like to know how he’s doing these days so Judge, if you see this, could you drop a comment and let us know what you’re up to? I hope you are well and have found new outlets for your gifts.

A judge has lost his job in the Phillipines, on the grounds that he regularly consulted with imaginary mystical dwarves who would join him in 'healing' sessions.
Judge Florentino Floro, from Manila, was originally removed from his post in April, after it emerged that he believed himself to be psychic, and that he would begin his court session with readings from the Book of Revelation.
In appealing that decision, Judge Floro mounted a staunch defence of the existence of his three dwarf friends - who were named Armand, Luis and Angel - telling the court in a letter that they had made a covenant together.
'From obscurity, my name and the three mystic dwarves became immortal,' he added.
In addition to the mystical dwarves, Judge Floro also reportedly believed that he was able to forsee the future, that he could inflict pain on others, and that he was the angel of death. He would change his judicial robes from blue to black every Friday to recharge his psychic powers.
The court found that he was unable to carry out his duties due to 'mental unfitness', adding that this could 'erode the public's acceptance of the judiciary as the rational guardian of the law.'

I had a post about former Judge Floro a while back, he even left a comment on the story and I told him that I would write a follow up post on his story when I had the time. Obviously, I was not able to do that. Then, picking up a free copy of the Asian Wall Street Journal, I came upon this story.

Former Judge Florentino Floro has hit the big time. When I first read about him, his story was featured in Reuters. Now he is in the Wall Street Journal story which was picked up by one of my favorite blogs.

Then and now, his claim is that he should not have been relieved of his position because
"It shouldn't matter what I believe in, whether it's Jesus, Muhammad, or Luis, Armand and Angel,"
On the face of it, he is absolutely correct, it does not matter what he believes in, as long as he does his duties as a Judge fairly and honestly. And the Philippine Supreme Court resolution that relieved him of his position actually states this fact
"There is no indication that Judge Floro is anything but an honorable man. And, in fact, in our disposition of the 13 charges against him, we have not found him guilty of gross misconduct or acts or corruption"
But he was not relieved of his position because of what he believed in, he was relieved of his position because of
"the findings of psychosis by the mental health professionals assigned to his case indicate gross deficiency in competence and independence."
In the WSJ article, it states that
"He passed a mandatory psychiatric evaluation applied to all prospective judges and was sworn in as a regional trial-court judge in November of that year, handling both civil and criminal cases in Malabon, a district in greater Manila."
What is not stated in the article, that he failed two previous psychiatric tests in 1995 and 1998 because as stated by the evaluating psychologists in 1995
"evidences of developing psychotic process"
and in 1998
"he is at present not intellectually and emotionally equipped to hurdle the responsibilities of a judge and he may decompensate when exposed to anxiety-provoking and stress-laden situation"
but
Because of his impressive academic background, however, the Judicial and Bar Council (JBC) allowed Atty. Floro to seek a second opinion from private practitioners. The second opinion appeared favorable thus paving the way to Atty. Floro’s appointment as Regional Trial Court (RTC) Judge of Branch 73, Malabon City, on 4 November 1998.
The Supreme Court came to regret this decision by the JBC because despite all the psychoilogical findings against former Judge Floro, the SC states
"It goes without saying that Judge Floro’s appointment as RTC judge is fait accompli. What awaits us now is the seemingly overwhelming task of finding the PROPER, JUST AND EQUITABLE solution to Judge Floro’s almost seven years of suspension in the light of the fact that the penalty imposed herein does not merit a suspension of seven years."
The Philippine Supreme Court tried to do the just and equitable thing, and judging by Judge Floro's actions after his relief, I say the Philippine Supreme court succeeded.

I was talking to a friend, and we both feel a bit sick of all the political jockeying in the news at the moment. So, let’s look at some different news.
1. Luis, Armand and Angel
I wrote a post about bizarre lawyers last year. One was Philipino judge Florentino V. Flores Jr, a trial judge who believed he was assisted by three elves, Luis, Armand and Angel. As this article in the Wall Street Journal explains, the story doesn’t end there. Apparently, belief in elves (or "duwende") is common in the Philippines, and Mr Floro has become a cause celebre.
Apparently it’s all down to Luis, the "king of kings" and avenger elf, rather than Mr. Floro personally.

Filipino Justice Consulted 3 Dwarfs

Dismissed Filipino Judge Florentino Floro lost 3 appeals to the Philippine Supreme Court and is jobless. But he, nonetheless, remains a world celebrity. As gifted, he predicted on 1998 the 2001 downfall of former Philippine President Joseph Estrada.
Assisting him in court proceedings are his 3 invisible guides: "Angel," neutral force; "Armand," a benign influence; and "Luis," the "king of kings," the avenger. These elves, or "duwendes," helped Floro to heal patients by supernatural powers.
Floro wrote dire prophecies on the judiciary. On January, 2007, a fire destroyed the court's session hall while justices and their loved ones died or had been ill. Ergo, on July, the Court cited the dwarf judge in contempt for "ungodly reprisal."

Fired Judge Blames Elf for Court Mishaps

The Philippines Supreme Court has asked a fired judge who claims he is assisted by three elves to stop making threats of "ungodly reprisal."
The court kicked Florentino Floro Jr. off the bench largely because of his belief in the supernatural, the Wall Street Journal reports (sub. req.). A medical clinic determined that the judge was suffering from psychosis.
Since then Floro has battled to get his job back, appearing on TV and winning converts who seek his healing powers. At the same time, a series of unfortunate incidents have befallen the supreme court justices or their families, including serious illnesses and car accidents.
Floro says the person to blame for the mishaps is one of the elves, "Luis," a "king of kings" who is an avenger. He told the newspaper that the elves help him predict the future, but he has never consulted them when issuing judicial decisions.

Via Ed Cone I found one of those stories that makes me love the Wall Street Journal: "In the Philippines, Ex-Judge Consults Three Wee Friends":

Oh my.

While it's not common in these parts for adults to claim that they're in regular contact with invisible elves, apparently, in the Philippines, an elf (or "duwende") is as plausible a critter as a vampire -- which is to say, lots of folks believe in them. Still, it would seem that it was an unusual enough thing for a trial-court judge to claim that it made judicial officials uncomfortable. That their medical clinic determined Mr. Floro suffers from psychosis can't have helped, either.
In 1999, Mr. Floro invited officials from the Supreme Court's administration unit to inspect his small courtroom. What they found unnerved them, and the Supreme Court convened a hearing to determine whether Mr. Floro should be removed from the bench.
According to Supreme Court papers, the court investigators presenting evidence at the hearing said they found Mr. Floro wearing blue robes instead of the normal black. Mr. Floro's own witnesses testified that he wore black on Fridays to "recharge his psychic powers."

The court investigators also reported that Mr. Floro began court proceedings with readings from the Book of Revelation and conducted hands-on psychic healing sessions for members of the public in his chambers during recesses. The investigators said Mr. Floro would sometimes enter a trance to write his rulings.

During the hearing, Mr. Floro revealed his contact with his elves.
As I read it, this seems to be saying that there were worries about Mr. Floro's performance prior to the revelation that Angel, Armand, and Luis were in the picture. (Who knew that blue robes would be an issue?) But it doesn't sound like this additional information about the elves counted as a positive for his competence on the bench.
Should they be counted against his competence? If Mr. Floro hadn't been performing psychic surgery on the job, reading from the Book of Revelations in the courtroom, and wearing those non-regulation blue judicial robes, would his belief in the elves be reason enough to remove him from the bench? Mr. Floro argues that it would not:
Mr. Floro says he never consulted the invisible elves over judicial decisions and the fact that he puts faith in them should make no difference to his career. "It shouldn't matter what I believe in, whether it's Jesus, Muhammad, or Luis, Armand and Angel," he says in an interview.

In other words, Mr. Floro is arguing that his faith in the elves is a personal matter, and something quite distinct from his job performance as a trial judge. In the case that he really was making his rulings on the basis of sound principles of jurisprudence, would it be possible to count his elfin inclinations as idiosyncratic but irrelevant?

Or is the belief in elves necessarily a sign of a state of mind incompatible with sound judicial reasoning in the real world we all share?*
In March 2006, after lengthy delays, the Supreme Court finally dismissed Mr. Floro from the court service, largely because of his belief in the supernatural. Even though Mr. Floro says the elves played no part in his judicial decisions, the Supreme Court justices said his broad faith in mysticism and supernatural phenomena had affected his work. "Lest we be misconstrued, we do not denigrate such a belief system," Associate Justice Minita Chico-Nazario wrote in the Supreme Court's verdict. "However, such beliefs, especially since Judge Floro acted on them, are at odds with the critical and impartial thinking required of a judge under our judicial system."
If I'm reading this right, the Supreme Court's verdict seems to indicate that Mr. Floro was acting on his belief in the three invisible elves in the course of his duties as a trial judge. Does this mean that they weren't influencing his rulings but, say, he acknowledged their presence in the courtroom? (I'm guessing that might wig out defendants.) Surely, there are more components of the job performance of a trial judge than the authorities he consults when writing his decisions.
But if Mr. Floro had better compartmentalized his work life and his personal life, would we (or the Supreme Court of the Philippines) be OK with his continued service as a trial judge?

It strikes me that there's a tension here not unlike that in the Marcus Ross case. On the one hand, our confidence in a particular methodology for decision making (whether scientific or judicial) makes us inclined to say that deploying that methodology will get us reasonably objective and impartial results that have relatively little to do with the details of which particular people are using that method. On the other hand, there are some beliefs that strike us as pretty likely to compromise objectivity and impartiality.

It would be nice to have some empirical data on how compatible elf-belief is with competent exercise of jurisprudence, or of the scientific method. As well, getting some independent confirmation of Mr. Floro's psychosis (to make sure there were other indicators besides elf-belief) would be useful. Otherwise, our inclination to take elf-belief as a disqualification from being a judge (or a scientist) looks like an attractive hypothesis without a whole lot of support.

*I suspect some folks would want to make an appeal to community standards here (where Mr. Floro lives in a community in which his belief in the elves is not so outrageous), and others will respond that judges and others with significant authority in society must rise above community standards and try to latch onto something more truth-like. I see the intuitive appeal of each of these positions.

I don't think there's any way you can defend a standard whereby believing in and consulting with elves is "necessarily a sign of a state of mind incompatible with sound judicial reasoning in the real world we all share", but believing in and consulting with God isn't.
The psychosis thing, though. That probably should be considered a showstopper.

That hot dog stand would of course be Top Dog, the libertarian hot dog vendor.
If the judge really does compartmentalize the elf beliefs, then I'd be inclined to say that they shouldn't disqualify him. I would guess that a very large proportion of people who are in such positions have some set of beliefs or other that are equally ludicrous, and we don't want to disqualify all of them. Of course, we'd want very good evidence that the beliefs really are compartmentalized once we find out about them.

I observed, as did an attorney with which I was associated, a Superior Court Judge in California state on the record that he refused to read a 100+ page document in the day's hearing "because it was filed yesterday."
The fact was, according to the document itself and the clerk's date stamp, that it was filed 9 days earlier, not "yesterday."
Plaintiff filed a Motion for Reconsideration, and paid the attorney to appear again on the same matter.
"Your honor," began the attorney in the Motion to Reconsider, "The Court believed..."
The Judge interrupted. "I believed?"
"You are the Court.." continued the attorney, and was cut off again.
"There being no new facts, this motion for reconsideration is denied," said the Judge. And he banged his gavel, ending the hearing.
In the Minute Order, this was described as" Counsel argue. There being no new facts, this motion for reconsideration was denied."
I asked a clerk in another department. "Does Judge Xxxxxx sometimes not know what day it is?"
The clerk rolled her eyes. "I'm pretty new here, but even I know about him. Poor man."
Is this better or worse than belief in elves?
The tragic irony is that this was a lawsuit about Legal Malpractice, where Plaintiff's attorney was fairly good, until more and more frequent lapses of memory.
On my suggestion, Plaintiff filed another Motion for Reconsideration, deeming the old, un-read document, to constitute New Information, the Court not having considered it before. Plaintiff also explicitly pointed out the appearance of bias, where it seemed that a judge with memory or cognitive problems was in abuse of discretion to protect a defendant with memory or cognitive problems -- who just happened to have gone to the same law school. "I would prefer to deral with this here," wrote Plaintiff, "but if this motion is denied, I will have no choice but to take this matter before the Appellate Court for more public analysis."
The case is now in Appellate Court.
I've read about more egregious Judge misbehavior, but this is what I SAW with my own eyes, so I give it greater weight of evidence.
Again, Is this better or worse than belief in elves?

My wording wasn't clear enough -- elves are as plausible in the Philippines as vampires are in the Philippines, and apparently there are a fair number of vampire reports in the Philippines.
Possibly, though, the effect of Buffy the Vampire Slayer (and the declining status of the Keebler elves and Snap, Crackle, and Pop) is such that more Americans believe in vampires than elves.

Can't Make This Stuff Up: Law Edition

Former Philippines trial court judge Florentino v. Floro Jr. was fired from his seat on the bench last year after acknowledging that he regularly sought the counsel of three elves only he could see. You might have thought that would have ended his judicial career for good, but Floro is fighting back, waging a campaign to return to the bench. And advising him along the way, he says, are those same three elves. The Wall Street Journal has the full story.
Meanwhile, far from the Philippines, a Nebraska state senator has filed a lawsuit against God, accusing the deity of causing untold death and horror. According to Associated Press, Sen. Ernie Chambers filed the suit to make a point: that anybody can file a lawsuit against anybody. As for Nebraska's jurisdiction over God, Chambers notes that God clearly has sufficient contacts with the state given that the Almighty is everywhere.

Finally, in Indiana, prosecutors are investigating whether a convicted forger tried to stay out of prison by forging her own obituary. Just before the woman was to be sentenced, the local newspaper published the phony obituary reporting her death and cremation. Someone faxed a copy to the sentencing judge, to no avail. Authorities found the woman at her home, very much alive, and the judge sentenced her to four years in prison. She said she had no idea who placed the obituary. Associated Press has the story.

Elves and God in Court

Two courts in different parts of the world are involved in situations involving entities who are difficult to verify the presence of. The Wall Street Journal reports on the Supreme Court in the Philippines had to rule on whether a judge who consults with three elves is competent:

Floro is fighting to get his job back, he has been on television, and converts people who believe in his healing powers. Meanwhile, a string of tragic happening are occuring for the supreme court justices and their families… Things like serious illnesses and terrible car accidents.
Floro claims the one to blame is one of the elves, "Luis" a "king of kings" who is quite vengeful. Floro has said that the elves help him predict he future, but has never consulted with the elves on judicial matters.
The Supreme court has not reversed any of Floro’s decisions.

The rarest of coconuts

Across Difficult Country's legal counsel Judge Florentino Floro Jr. is in the news again, this time on the front page of the Wall Street Journal.

As readers surely remember, Judge Floro was declared psychotic and removed from the bench for being in psychic contact with three invisible "mystic dwarves" 1 named Armand, Luis and Angel. Angel, Judge Floro tells the Wall Street Journal, "is the neutral force", Armand "is a benign influence", and Luis,"whom Mr. Floro describes as the "king of kings," is an avenger."

Now the Supreme Court which fired him is persecuting him again, issuing an "en banc resolution asking Mr. Floro to desist in his threats of 'ungodly reprisal.'"

While not stating explicitly, the Court appears to be blaming Judge Floro for a series of unfortunate events, including a "mysterious" fire which "destroyed the Supreme Court's crest in its session hall", and a string of accidents and illnesses numerous members of the court and their family members have recently suffered from.

It escapes me how Judge Floro could possibly cause these things to happen. It’s true the judge is a man of many talents, including the power to heal, but he’s not a warlock. To have the same people who declared the debonair Judge Floro mentally unstable merely because a few of his friends were invisible now essentially accuse him of casting spells on them is not only slanderous but also hypocrisy of the grossest sort.

The judge himself thinks the plague of misfortune is the handiwork of Luis. Given what we know about Luis that seems the most plausible explanation.

1The author of the WSJ article repeatedly refers to the beings, which Filipinos call dwendes, as elves. This is incorrect. For one thing elves don’t live in the tropics. For more, see one man’s story about his grandmother and the dwende, illustrated with a picture of naked ladies.

Dwende

My grandmother believed in dwende. Not Lorca's variation, but more of the Tolkien genus (our dwende are a sort of cross between Tolkien's dwerrows - or dwarves as most people misname them - and hobbits). She told me that alot of people made the mistake of thinking that dwende lived in earth mounds or punso. "No," she said. "How could people live in such small things? Its unrealistic and stupid." I go, riiiiiiiiight. We're talking about creatures no more than 2 feet tall, caucasoid with flowing white beards and pointy hats, and gramma wants to be realistic. However, seeing as how I was only a little over 5 years old at the time, I kept quiet. So she continued with her explanation.

Dwende, she said used earth mounds only as gateways to their cities which were underground. These cities were supposed to have been above ground a long time ago, but the movements of the earth eventually subsided them to where they are now; and they've been their for a little less than a million years. This, according to my gramma, was why many people still see dwende
above ground: they miss the sky.

Dwende cities do not have a sky, as you might imagine. Instead they have very high ceilings of intertwined plant roots, including tree roots and grass roots. These ceilings were painstakingly grown on by the dwende starting from when they learned that their cities were slowly sinking. It took each city a thousand years to grow their ceilings, my gramma said, explaining why dwende hated people who destroyed trees and why we had to always say "tabi tabi po" - a kind of warning combined with a plea for forgiveness for the intrusion - before we stomped around gardens or pulled up particularly ancient looking clumps of weed.

Being an aspiring archaeologist at that age, I looked at her askance. If there are dwende cities underground, why haven't they been dug up yet? I demanded to know. She smiled at me and patiently explained a little more.

No one has ever dug that deep, she said. Dwende ceilings begin about half a mile under the surface, and the tops of the highest buildings in the dwende cities are about another mile farther down. "So it's hot down there because of the m-m-magma?" I said, struggling with the word but terribly proud to show off that I knew how to use it in a sentence.

"It would be," she said, "but before you get to the magma (big smile at me to show that she noticed my use of the word) there are many big rivers buried deep in the rock."As my gramma explained it, the water of these rivers came from sinkholes near the north and south poles, starting their journey under the earth as chunks of ice. As the ice from the north flowed down to the south pole and vice-versa, the ice melted, taking most of the magma's heat. Not all of it, though, so the dwende cities had warmer climates.

Did they have a sun? I asked. My gramma shook her head firmly: no. That's ridiculous, she said. The dwende didn't have a sun, but the tree-root ceiling has many plants and animals that give off light light fireflies. I nodded sagely. I had discovered fireflies just the night before, so I understood what she was talking about. Animals - and plants - like fireflies, she said, followed a biological clock that told them when to switch their lights on and off. So imagine a million million million of these animals, she told me, all slowly turning their lights on and just as slowly turning their lights off, with some forgetting to do it when everything else has gone dark. That, she said, is biological night and day.

I pestered her for more details, but she said she was tired and that she would continue explaining things to me in the morning. I went to bed that night wondering if I wasn't in some underground city, watching stars that were really just lit up mushrooms and bugs. It made me feel real small and - even at that young age - helped me understand perspective.

My brother sent me this article yesterday. At first, it struck me as very unusual. After I thought about it for a little while, though, I realized it's no more unfathomable to me that someone might believe in such a thing as guiding elves as opposed to, say, guardian angels, or what have you.

UNDAUNTED by his threats of "ungodly reprisals," Supreme Court (SC) magistrates on Wednesday ordered a dismissed Malabon judge to stop badgering them with phone calls and pleadings seeking a review of his case.

The SC said Floro failed to present convincing arguments and substantial evidence to warrant a modification or reversal of its March 31, 2006 decision that ordered his relief as judge of Branch 73 of the Malabon Regional Trial Court (RTC) due to a "medically disabling condition of the mind that renders him unfit to discharge the functions of his office."

In the assailed decision of the SC, penned by Associate Justice Minita Chico-Nazario, Floro was separated from service due to his "delusional" tendencies, citing his admissions in several occasions that he decides his case with the guidance of his three dwarf friends whom he named Armand, Luis and Angel.
As a matter of equity, the Court resolved to award Floro back salaries, allowances and other economic benefits corresponding to three year.

Floro was sued by the Office of the Court Administrator which investigated about 13 administrative cases lodged against him by his own judicial staff. The SC found him guilty of seven out of 13 administrative charges and ordered him to pay the amount of P40,000 as penalty.
In a motion for reconsideration, in which pages of stories about himself were interspersed, Floro alleged that the six government doctors who examined him counterfeited his intelligence quotient and wrongfully declared him as mentally impaired.
He asked that an impartial panel of doctors who are experts who are likewise gifted to assess his psychic powers should be commissioned to examine him to determine his true mental state.
The beleaguered judge said that the amended Rule 140 in the Rules of Court never included weirdness, healing, psychic phenomena and the like as grounds for discipline.
"Insanity is, but respondent has never been declared insane," he said, noting that his gift "dwell in the realm of both religious and religious belief, free exercise and expression or parapsychology, and beyond the four corners of medicine, psychiatry and psychology."
Floro - who has repeatedly cited in his motion that was the brightest in his class and graduated with honors from Ateneo de Manila and even landed 12th in the 1983 Bar exams - said the SC should not allow itself to be dictated upon by in a proceeding to remove judges based on the medical incapacity of doctors, whose claims are mere hearsay evidence and thus inadmissible.
Dr. Celeste Vista in her report to the SC cited that despite Floros impressive educational background, there is "impairment in reality testing which is an indicator of a psychotic process, such that, cultural beliefs in dwarfs, psychic and paranormal phenomena and divine gifts of healing have become incorporated in a delusional system, that it has interfered and tainted his occupational and social functioning."
But Floro said he said he could not be held liable for Vista's emotional incapability to accept his "gift" with empirical certainty.
Among the "phenomena" that he supposedly predicted were the failure of former President Joseph Estrada to finish his term, the 2001 terrorist attack at the World Trade Center in the US and the July 2001 fire that gutted the Malabon Hall of Justice, except his own sala, which he predicted on July 18, 1999.
He also mentioned his ability to inflict pain via energy transfer or to prevent forthcoming pains on a specific person during Fridays, on the condition that the person should alter his ways, lest they be punished, and his ability to see his little friends."

Censor and Censorship

I subscribe to the theory that those who call the loudest for censorship are usually hiding the most. Confirmation came recently when the British parliament declassified the proposed "talking points" intended to justify the government’s attempt to stop Penguin Books from publishing the unabridged "Lady Chatterley’s Lover", in 1960. D.H. Laurence had written the book in 1928 but because it used "that word" (the word was ****), and because it was about a working class lad "****" an upper class lady, it offended a lot of people who thought they should determine what obscene. In his closing the prosecutor asked the jury if this was the kind of book they wanted their "wives and servants" to read. There hours later the jury delivered their verdict, the equivalent of, "****, yeah. Why not?"

And if an established faith won’t sell you the uncensored truth you can always invent your own, as did Manila Judge Florentino Floro. The judge opened his court each day with a reading from the Book of Revelation. Every Friday he changed from his black robes to blue ones, because they recharged his psychic powers with which he could foretell the future, heal or inflict pain upon others, and transform himself into the Angel of Death. Florentino knew this was all true because he and his loyal sidekicks, three invisible dwarfs named Armand, Luis and Angel, had a covenant together. Florentino V. Floro Jr. is was a trial judge in Manila, Philippines. Things were going fine for Florentino until he saw fit to inform the public that he has three tiny little friends - elves that only he can see and hear.
When elves take the law into their own hands...

After being fired, Floro latched on to the gullibility of an already superstitious public, became a media celebrity and has now vowed to exact revenge on the Supreme Court, using the talents of his invisible buds:

"It shouldn't matter what I believe in, whether it's Jesus, Muhammad, or Luis, Armand and Angel"

Angel, Armand and Luis are the elves' names, in case you're interested. Floro calls Luis "the king of kings". Plenty of people are lining up and defending Floro, saying that his beliefs should be just as valid as those who pray to Jesus for help. I agree with that, but I think that I would go a bit further and say that if a judge talks to someone who isn't there, whether he has pointy ears or wears sandals, perhaps he's really more suited to be a weird, vengeful media personality than to help decide the fate of the accused.

Just sayin'.

For consideration are the Verified Complaint/Letter-Affidavit dated August 25, 2006 and Verified Another/Supplemental Complaint/Letter-Affidavit (sic) dated September 1, 2006 filed by former Judge Florentino V. Floro, Jr. against two court personnel from the Office of Senior Associate Justice Reynato S. Puno of this Court.
While this Court, in cases of this nature, would normally have proceeded to a statement of relevant facts and allegations, it bears noting early on that the complaint is couched in such obscure language as to render that task very difficult, if not impossible.
Parenthetically, it may be recalled that, earlier this year, this Court, in Office of the Court Administrator v. Floro,[1] relieved herein complainant of his duties as a trial judge. Cited among the grounds for his relief were complainant's unusual beliefs which were "at odds with the critical and impartial thinking required of a judge under our judicial system." Thus, this Court noted:
Moreover, Judge Floro himself admitted that he believes in "psychic visions," of foreseeing the future because of his power in "psychic phenomenon." He believes in "duwendes" and of a covenant with his "dwarf friends Luis, Armand and Angel." He believes that he can write while on trance and that he had been seen by several people to have been in two places at the same time. . . .[2] (Emphasis supplied)
Regrettably, the complaint displays vagueness of expression and want of logical thought that it may be described as bearing a trance-like character. Consider, inter alia, the following statement in the complaint:
"Respondents Jasmin Mateo's and Marilyn Puno Santiago's formidable Lust for Power and Glory --- brought them not to the Land of Fantasy, not to Never Land, not to the Island of the Fairies, but to the Enchanted Kingdom of the 3 Mystic and Healing Dwarves --- They would try anything just to . . . They wanted to look inside the CRYSTAL BALL of Luis Armand and Angel[.]"[3] (Underscoring, emphasis, and ellipsis in the original)
The surreal frame in which the complaint was crafted is heightened by the several pictures, printed in full color, interspersed therein, none of which contributes to clearing the obscurity. In one page of the complaint, for instance, there are three pictures: two appear to be logos or seals bearing the Latin word "veritas," while the other seems to be a cover of a foreign religious comic book bearing the title "Veritas".[4] While they almost fill up an entire page, the pictures appear to have no relevance other than complainant's mention of the word "veritas" somewhere in the complaint.
Add to these pictures of clouds and flowers, icons of Mary and St. Peter, pictures of Mahatma Gandhi, Edu Manzano and Justice Sabino de Leon, the logo of a restaurant, a cartoon character, etc., and one would look at the complaint as more reminiscent of a dream-like stream of consciousness than a seriously drafted pleading for the Supreme Court, or any court of justice for that matter.
To consider the complaint any further would only waste precious time which this Court can more fruitfully devote to cases of significance and more pressing urgency.
The complaint must thus be dismissed outright.
WHEREFORE, the Verified Complaint/Letter-Affidavit dated August 25, 2006 and Verified Another/Supplemental Complaint/Letter-Affidavit dated September 1, 2006 are DISMISSED.

The Elven Supremacy

Florentino Floro Jr. used to be a judge down in the Philippines. But not anymore, because it seems that the country’s Supreme Court was a bit tired of Floro being, uhm, crazy. Specifically, a medical clinic tested Floro and determined that he was actually suffering from psychosis, which explains this whole elf thing.

Floro has been on a campaign to get his job back, claiming that he has magical healing powers and that he will take “ungodly reprisal” against the Philippine Supremes if they don’t let him back. The Supremes have asked him to kindly stop making these threats, as they’re not amused by any of this. They’re particularly not amused by the fact that, get this, “a series of unfortunate incidents have befallen the supreme court justices or their families, including serious illnesses and car accidents.”

Floro refuses to man up and take full credit for these incidents however, instead blaming three elves, including “Luis,” who’s an avenging elf. Floro says that Luis and the other two help him predict the future, and they’re the ones responsible for whatever mishaps have befallen the country’s Supremes.

Oh, and just to clear the air, Roco says “he has never consulted [the elves] when issuing judicial decisions.” Cause that would be crazy.

Arinday: Self-cherishing, psychosis & other oddities

N LIFE, we encounter a lot of oddities and beg for the sublime task to render the same into linguistic idioms.

If we say that he is an “odd man out,” the interpretation is as varied as the hues of the rainbow jealously misted by the dark nimbus cloud.

Can you recall of a former regional trial court judge in Bulacan who was eased out of his office because he was said to be suffering from psychosis according to Supreme Court magistrates?

Well, former RTC judge Florentino V. Floro Jr., who confessed cavorting with his three elfin friends (Luis, the “neutral force; Armand, a “benign influence”; and Angel, as the “king of kings” and as an “avenger” in the penning of his decisions), has become a sort of an international media celebrity.

No less than “The Wall Street Journal,” in its September 17, 2007 issue and bylined by James Hookway, featured the dismissed judge who claimed in an interview that: “It shouldn’t matter what I believed in, whether it’s Jesus, Muhammad, or Luis, Armand, and Angel.”

What the former judge said is equivalent to “self-cherishing” as the fundamental concept of the Buddhist’s philosophy on “how to enhance cherishing love.”

In writing the verdict dismissing the judge, considering him as suffering from psychosis largely because of his belief in the supernatural, Associate Justice Minita Chico-Nazario said he has “his broad faith in mysticism and supernatural phenomena.”

“Lest we be misconstrued, we do not denigrate such a belief system...However, such beliefs, especially since Judge Floro acted on them, are at odds with the critical and impartial thinking required of a judge under our judicial system.”

It is not the first time that former Judge Floro attracted those engaged in human interest stories. He has been featured in English newspapers, international or regional, before “The Wall Street Journal” gave him some kind of prominence.

The world of mystics has intrigued me a lot like the paranormal analysis of psychic Jaime Lichauco and the so-called “supernatural” and extra-sensory perceptions.

Accordingly, “there is no accepted explanation of mysticism and few psychologists have interested themselves in its practice,” says The Columbia Encyclopedia.

Philosophers William James gave up after failing finding the answer. On the other hand, Henri Bergson made a significant philosophical evaluation.
Bergson, whose psychological or philosophical lectures were attended by “fashionable ladies” of his time surpassing that of Thomas Carlyle’s thought of mysticism as “subjective meditation” or a “vitalist philosophy” akin to romanticism.

The notion of Bergson’s philosophy is the strands of continuity in probing deeper into the mysteries of life like the growth of the folk-soul or beliefs on something outside of empiricism.

But former Judge Floro’s venture into the supernatural is overshadowed by the lawsuit filed by self-proclaimed agnostics of Nebraska, Senator Ernie Chambers of Omaha, seeking a permanent injunction against God as reported by foreign news agencies.

And lo, behold, the injunction suit was answered by “God” who was charged with “human oppression and suffering misses an important matter.”

As it was written, the answer was “signed by God,” citing St. Michael the Archangel as a witness,” and “God” was quoted that “I created man and woman with free will and next to the promise of immortal life, free will is my greatest gift to you.”

Ho-hum! Such strange things are component of life’s existence. How would we treat the Nebraskan state senator? Consign him to limbo? But the place is exclusively for those “under probation” or inmates in the purgatory.

Definitely, we cannot classify him on the same level with former Judge Floro, the latter being a firm believer in mystical matters, but Chambers is a class by himself.

Court Elves....

....are they anything like the house elves found in the Harry Potter series?

Instead of law clerks, for instance, a Philippine trial court judge sought counsel from "three elves only he could see" in, I assume, rendering his legal decisions. Who knows if Judge Florentino V. Floro, Jr., used the elves for guidance in other aspects of his life.

We Get By with a Little Help from Our Friends

A Filipino judge, unconscionably fired from his bench for hiring invisible (at least to the less perceptive among us) elves as court clerks, wants his job back. Florentino Floro Jr. says that if he is re-elevated to the bench (judges must be elevated to the bench because it's a few steps up) he'll call off the king of the elves, who's turned hit man, inflicting illness and car accidents on Floro's former bosses, the Supreme Court.

Floro says the elves only help him predict the future on his personal time, and never used them to help him make judicial decisions. Of course not: that would be unethical.

Thought the Wall Street Journal was square, unhip and afraid to take on any stories that reek of high weirdness? Uhm... no.

Maybe it's a creeping low-grade Rupertification over at the WSJ, but they recently did a piece on a Filipino judge who believes in elves:

'Dwarves of Law' update

Last year, we brought you an interview with Florentino Floro Jr. - the Filipino ex-Judge who apparently has healing powers and is counselled by a trio of mystical dwarves. The Wall Street Journal has an update on Floro's attempts to be re-instated as a Supreme Court Judge and also how he has become a celebrity in the Phillipines, regularly appearing on TV chat shows. It also states that there have been a number of odd incidents since Floro's removal from the Court system:

[...] a series of disturbing incidents appear to have the
nation's top jurists rattled. According to local newspaper reports, a
mysterious fire in January destroyed the Supreme Court's crest in its
session hall, and a number of members of the court and their close
family members have developed serious illnesses or have fallen victim
to car accidents.

Enough bizarre things have happened that in July, the
Supreme Court issued an en banc resolution asking Mr. Floro to desist
in his threats of "ungodly reprisal." The Supreme Court's spokesman
declined to elaborate.

Mr. Floro says he is not suffering from psychosis, and
that he's not to blame for the incidents. He points the finger squarely
at "king of kings" elf Luis, who Mr. Floro says is bent on cleaning up
what he says is the Philippines' corrupt legal system

Iceland Still Believes in Elves and Ghosts

According to a recent study on superstition in Iceland supervised by Terry Gunnell, associate folklore professor at the University of Iceland, a significant portion of participants would not rule out the existence of elves and ghosts.

The results of the study were similar to those of a study conducted in 1974 by Professor Erlendur Haraldsson, Fréttabladid reports.

“Icelanders seem much more open to phenomena like dreaming the future, forebodings, ghosts and elves than other nations,” Gunnell said.

Only 13 percent of participants in the study said it is impossible that elves exist, 19 percent found it unlikely, 37 percent said elves possibly exist, 17 percent found their existence likely and eight percent definite. Five percent did not have an opinion on the existence of elves.

More admitted to believing in ghosts. Only seven percent said their existence was impossible, 16 percent unlikely, 41 percent possible, 18 percent likely and 13 percent definite. Four percent had no opinion on the existence of ghosts.

Gunnell was surprised by the results because the Icelandic society has changed considerably since 1974 when Haraldsson revealed that more Icelanders believed in supernatural phenomena than other nations.

“Many factors could have affected these numbers,” Gunnell said. “A growing belief in haunting can be traced back to Hollywood movies. The city and its houses are also growing older and the countryside is becoming more mysterious.”

The study was undertaken in 2006 and 2007 by the University of Iceland’s Faculty of Social Sciences and supported by the university’s Research Fund. About 1,000 people participated in the questionnaires.

The results have not been fully assessed yet and interviews with some of the participants are scheduled in the near future. The final results of the study will be introduced in December.

There are certainly problems with this Judge from the Philippines:

But honestly can he really be any kookier than those we already have? In fact one of his Elves, Luis appears to have a sounder grip on reality than most British criminologists:

January 16, 2007, Updated 15:35:52 (Mla time), Tetch Torres, INQUIRER.net A TEAM from the Government Service Insurance System (GSIS) has inspected the damage that was caused by a fire inside the Supreme Court's session hall on Monday, a representative from the Office of the Chief Justice said Tuesday. Midas Marquez said the team would be drafting an evaluation report before reconstruction could start. "We have to wait for the GSIS evaluation report before proceeding with the plans of rehabilitating the session hall," Marquez said. Funds from the rehabilitation will come from GSIS funds -- being the high court's insurer. This is the first time that the high court's session hall had caught fire. A few years back, the Department of Justice (DoJ) had also caught fire, and was prevented from spreading to the Supreme Court. Marquez could not give an immediate estimate of the damage. "But I don't think it’s much because it’s only water damage and only one curtain caught fire," he said. The fire however failed to disrupt court activities, with the justices holding their first en banc session for this year at their lounge on the seventh floor."The en banc room is intact but it's still wet so they temporarily moved to the 7th floor," Marquez said. Meanwhile, oral arguments on a land dispute in Quezon City on January 30 will push through and will be held at the high court's session hall at its old building along Taft Avenue in Manila, said Marquez.

A fire hit the Supreme Court (SC) session hall in Ermita, Manila yesterday. Initial reports from the Manila Fire Department showed that the blaze started at 4 p.m. inside the session hall. Nobody was reported hurt by the fire, which damaged the facility. Supt. Pablito Cordeta, MFD Fire Marshal, said that the fire was due to faulty electrical wiring in the ceiling of the session hall. He said a spark ignited a flame which quickly spread towards the ceiling and walls and curtains of the session hall. Cordeta said that the fire was put out at 4:40 p.m. by 15 firetrucks. A portion of Padre Faura St. in Ermita was closed to traffic for responding firetrucks. Cordeta said that despite the damage it sustained, the session hall could still be repaired and restored. Faulty electrical wiring sparked a one-hour fire at the Supreme Court that partly damaged the session hall and tied up traffic along Padre Faura Street and Taft Avenue in Manila yesterday. Superintendent Pablito Cordeta, Manila Fire Department marshal, said the fire started around 3:52 p.m. at the newly refurbished session hall, located on the second floor. Chief Justice Reynato Puno said he was in a meeting in the building when the fire began. "I was in a meeting in the en banc conference room when I saw smoke coming out from the flooring. Immediately we went out of the room and that’s when the alarm went off," he told reporters. Cordeta said it was fortunate that the fire occurred during office hours and not in the evening when the building was empty with no one to notice the blaze. Puno assured that records of court cases were safe.

Pablito Cordeta said the blaze, which was caused by an electrical malfunction, reached the second alarm before it was declared out at 4:40 pm. He said no records were damaged during the incident. “It was an electrical short circuit that sparked the fire,” he told reporters, noting the presence of highly combustible curtains. At least six fire trucks rushed to the site. According to him, the fire gutted the en banc session hall, with the flames reaching the ceiling and perimeter wall. This prompted the evacuation of the employees and staff of the high court justices. No casualty was reported by arson probers. “There is only minimal damage to the structures,” observed Cordeta. In an interview, Chief Justice Reynato Puno said they were in conference at the time.“It started when we were having a meeting. The smoke came from one of the conference rooms,” said Puno, who was presiding over the briefing by the Office of the Court Administrator. ABRA Rep. Luis Bersamin Jr. and his police bodyguard were shot dead by two gunmen yesterday after the lawmaker attended a niece’s wedding at Mt. Carmel Church in New Manila, Quezon City. The 62-year-old Bersamin, a member of President Macapagal-Arroyo’s party Kabalikat ng Mamamayang Pilipino (Kampi), had just left the church on Doña Juana Rodriguez (formerly Broadway) Avenue and was walking back to his car when attacked. Justice Lucas Bersamin, the lawmaker’s younger brother, declined a TV crew’s request for comment. Bersamin’s murder came more than a month after a relative, Abra provincial board member James Bersamin, 66, was shot dead in the capital Bangued. Family members said the lawmaker had just stood as a sponsor at the marriage of his niece Pia, daughter of Justice Bersamin, to Niño Embuscado and was on his way to the reception when he was gunned down at around 5:25 p.m.“It was the recessional and everyone was going out of the church when we heard gunshots,” said Alvin Salonga, a guest at the wedding.

Nazario is favourable to Judge Floro; and Justice Bersamin and J. Nazario met and talked about Judge Floro’s case, and she read the internet posts of Judge Floro. After that meeting, Justice Bruselas and Judge Floro talked for about 20 minutes regarding the filing of disbarment case against C.J. Davide, and Judge Floro’s plea to Justice Bruselas for help regarding a JOB. Judge FLORO candidly informed Justice Bersamin of the IMPRECATION or curse upon the judiciary, and specifically added, is the curse upon ATENEO class 1982, where Judge Floro accurately predicted the fire roasting death of the wife and Marilou, daughter of Dep. BEGINNING this Sunday, three dwarves will work their powers against 14 of the 15 justices of the Supreme Court, a dismissed judge has warned as he filed his third motion for reconsideration for his reinstatement before the high tribunal. Judge Florentino Floro Jr. of the Malabon regional trial court was separated from service after medical findings showed that he was suffering from psychosis. The high court had said that Judge Floro lacked the judicial temperament and the fundamental requirements of competence and objectivity expected of all judges. It said that the findings of psychosis by the mental health professionals assigned to his case indicated gross deficiency in competence and independence. In his appeal, Floro said his three dwarf-friends -- Luis, Armand, and Angel -- appeared to him last week and told him that the justices would suffer their wrath for dismissing him. Floro said the sufferings of the Supreme Court justices would start midnight of November 5, the eve of his 53rd birthday. Floro said he appealed to his dwarf-friends to spare one justice, which according to him had been put into a vote by the three. Floro did not name him. "Voting en banc with full authority, Luis voted negative, Armand conditionally positive, upon full appointment of Judge Floro to a higher or equal position by virtue of the eliminated magistrate, while Angel voted neutral," Floro said. Because the voting was a tie, Floro said Luis agreed to spare one justice if he would spread oil on any part of the justice's house before November 5. Floro said he would follow the dwarves' advice and start praying every Friday so that the curse on the justices would work. "I will devote my entire life, Fridays, until my last breath, towards the fulfillment, execution, and coming to pass of this curse. With absolute faith in Luis, Armand and Angel -- Angels of God, I will fulfill my destiny: spell and karma upon them, all their loved ones, up to the 4th generation," Floro said. Judge Floro, who was appointed RTC Judge in November 1998, has admitted to having “psychic visions,” of having the ability to predict the future because of his power in “psychic phenomenon.” He said he believed in “duwendes” [dwarves] and forged a covenant with them. He also said that he could write while in a trance and that he had been seen by several people to have been in two places at the same time. He also likened himself to the “angel of death” who could inflict pain on people, especially upon those he perceived to be corrupt officials of the Malabon RTC. During court sessions, Judge Floro wore blue robes except on Fridays when he would wear a black robe and black outfit from head to foot allegedly to recharge his psychic powers. He also conducted healing sessions inside his chambers during breaks.

"MORE lawyers nowadays complain of corruption in the judicial system compared to 10 years ago, according to the Social Weather Stations. One out of two lawyers knows of a trial judge in their city or province who has taken a bribe but they did not report it because they could not prove it, said the SWS. In a briefing among lawyers Tuesday night, SWS president Mahar Mangahas said the perception of corruption in the various courts -- from the municipal trial courts all the way up to the Supreme Court -- has risen among lawyers in the last 10 years. "Our lawyers are more critical now than before," Mangahas told the lawyers as he presented the survey findings for the first time. The SWS polled 889 trial judges -- or 61 percent of all trial judges in the country -- and 400 lawyers from November 2003 to July 2004 to get their perceptions on various aspects of the judicial system.The last such survey was undertaken by SWS from 1994 to 1996. "Corruption remains a major problem," the SWS said in a press statement."As in 1995, one-fourth of present lawyers say that many or very many judges are corrupt. Although half or 49 percent say they know a case in their own city or province where a judge took a bribe, only 8 percent said they reported the bribery. The main excuse of those who kept silent is that they could not prove it," the SWS said.Among judges, only 7 percent said that many or very many judges were corrupt.The SWS said the judges' perception of the extent of corruption among court personnel was the same as in 1996."What has increased is the proportion of judges seeing many lawyers as corrupt," it said. Mangahas said the survey showed that corruption "remains a serious problem in the judicial system but it is not cultural.” "They're saying there's nothing to be done about (corruption) but it's not accepted. There's still the idealism," he said."

There was particularly hot competition in 2006 for the prize for judge of the year. William A. Carter, of the Albany City Court in New York, was a strong contender after being censured by the State Commission on Judicial Conduct for his behaviour when presiding at a preliminary hearing of criminal charges: he removed his judicial robe, walked up to the defendant and asked: “You want a piece of me?”. In Washington State, Superior Court Judge Beverly G. Grant began a manslaughter sentencing hearing by asking everyone in court to join her in a Super Bowl cheer of “Go Seahawks”. She later explained that she was simply trying to ease tensions. Judge Donald D. Thompson was convicted by a jury in Oklahoma on four counts of indecent exposure by surreptitiously using a penis pump in Creek County Court while sitting as a judge hearing (or at least pretending to hear) trials in 2002 and 2003. The judge picks up a consolation award for the least contentious statement by a defendant in a criminal trial this year: “In 20-20 hindsight, I should have thrown it away.”

Those were the runners-up. The award for judge of the year goes to Judge Florentino V. Floro Jr, whom the Supreme Court of the Philippines sacked from the Regional Trial Court in Malabon City for regularly opening proceedings in his courtroom with the statement that he was “a Bar topnotcher” who passed the 1983 Bar examinations “with an average score of 87.55 per cent”; for changing from blue court robes to black each Friday “to recharge his psychic powers” as “the No 5 psychic in the country”; and for claiming to have the assistance of “three dwarf friends named Luis, Armand and Angel”, who, unseen by others, provided him with assistance in court."

The Hope Diamond is a large (45.52 carat), deep blue diamond, currently housed in the Smithsonian Natural History Museum. The diamond is legendary for the misfortunes it supposedly visits upon its possessors. The Hope Diamond's history can be traced to a blue diamond named the Tavernier Blue, which was originally mined from the Kollur mine in Golconda, India, and was a crudely cut triangle shape of 112 3/16 carats (22.44 g). French merchant-traveler Jean-Baptiste Tavernier purchased it sometime in 1660 or 1661. According to legend, the Tavernier Blue was stolen from an eye of a sculpted idol of the Hindu goddess Sita, the wife of Rama, the Seventh Avatara of Vishnu. The diamond was one of the 2 eyes of the idol. When the priests noticed it was missing, they placed a curse on whoever owned the diamond. One reason that this is not accepted is that the Hope's sister has not been found.
The Curse: The first stories about the supposed curse of the Hope Diamond surfaced in 1909. In the June 25 issue of The Times an article written by the Paris correspondent listed a number of supposed owners who had come to an ignoble end. Tavernier supposedly died of fever soon after (he actually lived to 84, and was not torn apart by wolves). The Hope Diamond was blamed for the fall from the king's favor of madame Athenais de Montespan and French finance minister Nicolas Fouquet, the beheadings of Louis XVI, Marie Antoinette and the rape, mutilation and beheading of the Princesse de Lamballe. The legend added fictitious persons: diamond cutter Wilhelm Fals (killed when his son Hendrik stole it); Hendrik Fals (suicide); Francois Beaulieu (starvation after he sold it to Daniel Eliason). Makakaranas ng sunud-sunod na kamalasan at posible umanong mamatay isa-isa ang mga mahistrado ng Korte Suprema simula sa Linggo ng hatinggabi. Ito ang nilalaman ng pangatlong "motion for reconsideration" ni dating Malabon Regional Trial Court branch 73 Judge Florentino Floro Jr. na inihain nito na naglalayong makabalik siya sa nasabing posisyon.

Sa nabanggit na mosyon ni Floro, magdaranas ng sumpa ang mga mahistrado ng Korte Suprema gayundin ang kanilang mga kamag-anak hanggang sa ika-apat na saling lahi. Ito anya ang napagkasunduan ng tatlong duwende na sina Armand, Luis at Angel na nagpakita sa kanya noong nakaraang linggo matapos na tila mag-"en banc session" ang mga ito. Inilakip ni Floro sa kanyang mosyon ang mga larawan ng tatlong duwende na tila kamukha ng komedyanteng "three stooges."

Nagalit umano ang mga nasabing duwende sa hudikatura dahil sa pagtatakip ng mga ito sa katotohanan partikular na sa kanyang kaso. Magsisimula umanong matupad ang sumpa sa hatinggabi ng Nobyembre 5 kasabay ng ika-53 kaarawan ni Floro.
Isa lamang umano sa mga mahistrado ang makakaligtas sa nabanggit na sumpa matapos na pakiusapan ni Floro ang tatlong duwende na huwag itong idamay. Hindi naman tinukoy ni Floro kung sino sa 15 mahistrado ang hiniling niyang huwag mapasama sa sumpa ng kanyang mga kaibigang duwende. Magugunita na sinibak ng SC si Floro dahil sa umano’y weird na pagsasagawa nito ng hearing sa kanyang sala at pagkonsulta sa mga nasabing duwende sa pagpapalabas ng desisyon.

SWS survey: Lawyers say judiciary more corrupt

MORE lawyers nowadays complain of corruption in the judicial system compared to 10 years ago, according to the Social Weather Stations. One out of two lawyers knows of a trial judge in their city or province who has taken a bribe but they did not report it because they could not prove it, said the SWS. In a briefing among lawyers Tuesday night, SWS president Mahar Mangahas said the perception of corruption in the various courts -- from the municipal trial courts all the way up to the Supreme Court -- has risen among lawyers in the last 10 years. "Our lawyers are more critical now than before," Mangahas told the lawyers as he presented the survey findings for the first time. The SWS polled 889 trial judges -- or 61 percent of all trial judges in the country -- and 400 lawyers from November 2003 to July 2004 to get their perceptions on various aspects of the judicial system.The last such survey was undertaken by SWS from 1994 to 1996.
"Corruption remains a major problem," the SWS said in a press statement."As in 1995, one-fourth of present lawyers say that many or very many judges are corrupt. Although half or 49 percent say they know a case in their own city or province where a judge took a bribe, only 8 percent said they reported the bribery. The main excuse of those who kept silent is that they could not prove it," the SWS said.Among judges, only 7 percent said that many or very many judges were corrupt.The SWS said the judges' perception of the extent of corruption among court personnel was the same as in 1996."What has increased is the proportion of judges seeing many lawyers as corrupt," it said.
Mangahas said the survey showed that corruption "remains a serious problem in the judicial system but it is not cultural.” "They're saying there's nothing to be done about (corruption) but it's not accepted. There's still the idealism," he said.

The Philippine Supreme Court dismissed Judge Floro's Disbarment Case
and it NOTED WITHOUT ACTION Judge Floro's 2nd Appeal to be reinstated.

DECISION

Judge Floro will file the motion for reconsideration and 3rd appeal (allowed by Soria case), respectively. The MOTION and 3rd appeal will be based on truth: (What for, and) Why did Justice Nazario approach Justice Hermosisima, Jr. at the dinner before February 10, 2006 to settle my case for a Price:
TRUTH HAS NO PRICE.
Judge Floro will add an ALTERNATIVE MOTION TO EXPUNGE FROM THE CURSED ROLLO, the 3rd Appeal (to be filed before the end of the 15 day period counted from October 19, the day he personally received the Cursed Resolution) so that it/the pages thereof may be prayed for every Fridays at 3pm and 12 midnights and flashed upon by the violet and white lights of LUIS, thereby awaiting the CURSED DECISION's SPELL and KARMA upon the loved ones UP TO THE 7TH GENERATION of (inflicting illnesses, of stroke, cancer and nerve disorders, inter alia, upon) all the 15 Supreme Court incumbent, past and future Justices, judges, justices and members of the CURSED JUDICIAL AND BAR COUNCIL, of the judicial department.

the Bible says that a man's Legacy stays with him through the 7th generation,
“But now, I pray, let the power of the Lord be great, xxx but He will by no means clear the guilty, visiting the iniquity of the fathers on the children to the third and the fourth generations.” (Numbers 14:17-20)
Exodus 34:6,7:
“Then the Lord passed by in front of him and proclaimed, ‘The Lord, the Lord God xxx yet He will by no means leave the guilty unpunished, visiting the iniquity of fathers on the children and on the grandchildren to the third and fourth generations.’”
Imprecation leaves action to God. It is much better to ask God to avenge us (and therefore, leave it to God than to take vengeance ourselves).
Jesus does not want us to remain in a situation of seething anger, embittered toward the enemy. He wants to release us from that prison, to let it go and move on.
In Matthew 5 , Jesus says: “You have heard that it was said, ‘You shall love your neighbour and hate your enemy.”
I WILL DEVOTE MY ENTIRE LIFE, FRIDAYS, UNTIL MY LAST BREATH, TOWARDS THE FULFILMENT, EXECUTION AND COMMING TO PASS OF THIS CURSE. WITH ABSOLUTE FAITH IN LUIS, ARMAND & ANGEL, ANGELS OF GOD, I WILL FULFIL MY DESTINY: SPELL & KARMA UPON THEM, ALL THEIR LOVED ONES, UP TO THE 4th GENERATION.

The Philippine Supreme Court dismissed Judge Floro's Disbarment Case
and it NOTED WITHOUT ACTION Judge Floro's 2nd Appeal to be reinstated.

DECISION

Judge Floro will file the motion for reconsideration and 3rd appeal (allowed by Soria case), respectively.

The appeal will be based on truth:

Why did Justice Nazario approach Justice Hermosisima, Jr. at the dinner before February 10, 2006 to settle my case for a Price:

TRUTH HAS NO PRICE.

Judge Floro will add an ALTERNATIVE MOTION TO EXPUNGE FROM THE CURSED ROLLO, the 3rd Appeal (to be filed before the end of the 15 day period counted from October 19) so that it/the pages thereof may be prayed for every fridays at 3pm and 12 midnights and flashed upon by the violet and white lights of LUIS, thereby awaiting the CURSED DECISION's SPELL and KARMA upon the loved ones UP TO THE 7TH GENERATION of (inflicting illnesses of stroke, cancer and nerve disorders, inter alia, upon)
all the 15 Supreme Court incumbent, past and future Justices, judges, justices and members of the CURSED JUDICIAL AND BAR COUNCIL, of the judicial department.

Judge Floro will devote his entire life to the fulfillment of his DESTINY: to implement, execute and satisfy the CURSE, SPELL and KARMA, upon the ponente, down to all the powerful persons above mentioned and all the respondents in the disbarment case.

Judge Floro will demand the TRUTH form Justice Nazario and the Chief Justice via a letter, per the ultimate weapon of LUIS:

THE CURSE, KARMA and SPELL thru the flashing of violet and white lights of LUIS, the King of Kings of Elementals.

The last pleading to be filed if expunged or otherwise will be burried in the graves of Justice De Leon, Jr. awaiting the death of the most painful death of the ponente and lingering illnesses of Justice Hermosisima, Jr.
and the 15 Justices, inter alia.

Upon the comming to pass of this prophecy, the CURSE will be compleat by violet and white lights FIAT upon all their loved ones UP TO THE 7th generation.
